Position Overview
The realm of Open Banking is rapidly evolving, poised to revolutionize various facets of financial services.

Mastercard has developed an initial suite of Open Banking Solutions and has acquired Finicity, a premier US-based data aggregation and analytics firm, as well as Aiia in Europe, with aspirations to broaden our global presence.

We are seeking a technology and transactional attorney to deliver legal support and guidance for product development and commercial sales within the North American Open Banking division.

Key Responsibilities
This full-time position is integral to the global Open Banking legal team. You will report to the Vice President of Mastercard's North American Open Banking legal team and provide legal counsel to product development and commercial business units.

  • Conduct legal and business risk assessments regarding new product frameworks, sales contracts, and market entry strategies associated with Mastercard's Open Banking offerings in North America.
  • Advise throughout the entire lifecycle of various solutions and services, from concept to development and launch.
  • Draft and negotiate technology sales, reseller, and vendor agreements.
  • Oversee contractual negotiations with diverse partners in the Open Banking ecosystem, including fintech companies, financial institutions, merchants, processors, and service providers.
  • Offer legal guidance on a broad spectrum of commercial and contractual issues.
  • Collaborate cross-functionally with product and legal teams (including data privacy, intellectual property, antitrust, regulatory compliance, and franchise) to ensure alignment with corporate strategy, internal policies, and applicable laws.
  • Engage with internal and external regulatory counsel regarding the implications of local laws and government regulations on Mastercard's North American Open Banking solutions.
  • Build strong relationships with product development, business, and sales teams, as well as senior management.
  • Ensure adherence to company policies and procedures.
  • Support initiatives of the Open Banking team both in North America and globally; assist international colleagues as necessary.
  • Manage special projects while maintaining a steady flow of daily responsibilities.

Qualifications
To be successful in this role, you should possess:

  • Robust transactional training and experience (in-house experience is preferred).
  • Experience with product development and Open Banking or other regulated products is a distinct advantage.
  • Strong business acumen and excellent communication skills to interact effectively.
  • A quick learner who can swiftly grasp complex and evolving products and navigate intricate legal and regulatory landscapes.
  • Meticulous attention to detail, with the ability to prioritize and manage multiple projects simultaneously.
  • Exceptional drafting and negotiation skills across a variety of complex commercial contracts, with the capability to analyze and identify key legal issues.
  • A collaborative mindset, willing to take on diverse responsibilities that support the team, department, and organization.
  • The ability to work both independently and collaboratively, including with global colleagues, while also taking direction from managers and team members as appropriate.
  • A Juris Doctor degree from an accredited law school; licensed to practice law in the US.
