Position Overview

The role of Senior Counsel for Open Banking is crucial as Open Banking continues to reshape the financial services landscape. Mastercard has developed a robust suite of Open Banking Solutions and has strategically acquired leading companies in the sector to broaden our global reach.

We are seeking a knowledgeable technology and transactional attorney to provide comprehensive legal support for product development and commercial sales within our North American Open Banking division.


Key Responsibilities
  • Conduct legal and business risk evaluations on new product frameworks, sales contracts, and market entry strategies related to Mastercard's Open Banking offerings in North America.
  • Provide legal guidance throughout the product lifecycle, from conceptualization to launch and beyond.
  • Draft and negotiate agreements for technology sales, reseller partnerships, and vendor collaborations.
  • Oversee contractual negotiations with various stakeholders in the Open Banking ecosystem, including fintech companies, financial institutions, merchants, processors, and service providers.
  • Offer legal counsel on a broad spectrum of commercial and contractual issues.
  • Collaborate across product and legal teams (including data privacy, intellectual property, antitrust, regulatory compliance, and franchise) to ensure alignment with corporate strategy and adherence to legal standards.
  • Engage with internal and external regulatory advisors concerning the implications of local laws and regulations on Mastercard's North American Open Banking solutions.
  • Build strong relationships with product development, business, and sales teams, as well as senior management.
  • Ensure compliance with internal policies and procedures.
  • Support the initiatives of the Open Banking team in North America and globally, providing assistance to international colleagues as necessary.
  • Manage special projects while maintaining a steady workflow of daily responsibilities.

Qualifications
  • Demonstrated transactional experience, preferably in-house.
  • Familiarity with product development in Open Banking or other regulated sectors is advantageous.
  • Strong business acumen and excellent communication skills for effective interaction.
  • Ability to quickly understand complex and evolving products and navigate intricate legal and regulatory landscapes.
  • Detail-oriented with the capacity to prioritize and manage multiple projects simultaneously.
  • Proficient drafting and negotiation skills for complex commercial contracts, with the ability to identify and analyze key legal issues.
  • A collaborative team player willing to undertake diverse responsibilities that support the team and the organization.
  • Ability to work both independently and collaboratively, taking direction when necessary.
  • Juris Doctor degree from an accredited law school; licensed to practice law in the United States.
