1.Introduction


These provisions govern the use and website www.trabajo.org, which beBee Affinity Social Network S.L. ("beBee"), places at the disposal of Internet users, as well as of all the contents shown or made available on the aforementioned page to the aforementioned clients.


The General Conditions appearing at all times on this website will be those in force at the corresponding time.


Access to the website is free, except for the cost of connection through the telecommunications network by the network supplier contracted by the customers.


Access to the area "My account" is an exclusive service, intended for only registered and active beBee users. A customer is active once they have been through the registration procedures established in the website and when there is confirmation of the contractual link by sending confirmation of registration to the email address provided by customers during the registration process.


In the event of non-compliance by the customer with any of the obligations established in this website, beBee reserves the right to prohibit or deny the customer access to the "My Account" area of the website www.trabajo.org without prejudice to any other actions that may correspond to beBee.

beBee will provide the customer with a personal and non-transferable identifier and access code so that the customer may use the website or for the purposes of using the services offered by beBee. beBee shall not be liable for any communications failures, including deletion, incomplete transmission or delays in remission, nor shall it commit itself to ensuring that the transmission network is operational at all times. Neither will beBee respond in the event that a third party contravenes the security measures established by beBee and/or circulates and/or transmits computer viruses.


beBee has taken all measures of security existing to protect the personal data given by customers. Notwithstanding the foregoing, beBee cannot guarantee the absolute invulnerability of its security systems, nor can it guarantee the security or inviolability of such data as it is transmitted over the network. Likewise, beBee does not guarantee the veracity or validity of the data supplied by the client.


beBee does not control or guarantee the operability of the services or the absence of computer viruses in the services provided by third parties through its network of portals that may cause alterations in your computer system (software and hardware) or in the electronic documents and files stored in your computer system.


The purpose of the linking devices that beBee makes available to the client is to make it easier for them to search for information available on the Internet. beBee does not guarantee that the service is adequate for the performance of any service beyond that contracted or that allows access to all Internet sites. beBee does not offer or market the roducts and services available on the linked sites nor does it assume any responsibility for such products or services.


beBee as a service provider that is, does not control the use of the services that the client performs; in this sense, beBee is not responsible for the use and/or contents which, in contravention of the laws or the General Conditions and/or Special Conditions, every time that a customer makes a search. beBee is not responsible for the content and/or information and/or transmitted data, nor does it originate the transmission, nor changes the data, neither selects the data, and therefore the customer is the only one to be able to responsible for the consequences of use that is unlawful or contrary to these conditions, and the veracity and/or legality of the contents deployed by them. For the present purposes, the customer shall use the services in accordance with the applicable laws and regulations.


In the event that beBee had knowledge, by any means or form, whether directly or indirectly, of the existence of content that could infringe legality or the General Terms and Conditions and/or the Corresponding Special Conditions or the use for fraudulent, illicit and/or illegal purposes unauthorized, beBee reserves the right to suspend for any reason the provision of the services itself in whole or partly, without prior authorization from the the client, by removing the contents of the violators or any other measure it deems necessary to avoid continuity in the commission of the wrongful act or of the infraction detected, the client renounces to exercise any claim or right, of any kind, in the event that it occurred directly or indirectly, any mistake and/or error on the part of the beBee.


Without prejudice to the foregoing, beBee reserves the right to inform the administrative or judicial authorities of any facts that may constitute an illegal activity, without the need to give prior notice to the client.


In particular, beBee shall not be liable for any defective or interrupted performance of the services it markets and provides in the following cases:


  • Interruption of services as a result of maintenance operations on the network.
  • The discontinuity of the service as a result of the introduction, by the customer and/or any third party, of elements of hardware or software that cause bad general functioning of your computer equipment, or that are incompatible with the precise elements of the equipment.
  • Interruption of services as a result of unavaliabilty of Broadband access to support them.
  • Interruption of services caused by incorrect use or bad adequacy of them.
  • Interruption of services caused by failures in the supply in the electric current to the equipment or devices used by the customer.
  • Causes attributable to a third party or major cause.
  • Decrease in quality of service or flow rate of connection, for reasons not directly attributable to beBee.
  • Administrative or judicial decisions.
  • Bad configuration of the installation necessary by anyone other than beBee and/or by the customer and/or of any third party.
  • Damages and/or harm that is not imputable solely, directly and exclusively to beBee.
  • Loss of profit or lost profits by the client and/or any other third party.
  • Damages and harm, of any nature, that are caused by the fault of the customer and/or any third party.
  • Damages and harm caused directly or indirectly to the customer and/or third party for reasons not imputable solely, directly and exclusively to beBee.

Unpredictable events, as well as cases of force majeure, official measures and failure of the connections of telecommunications, not directly attributable to beBee shall exonerate the latter from the provision of the services for as long as they last.


7.Confidentiality


beBee and its personnel and technical service shall treat and keep confidential any and all customer information to which they have access. They will not use it, nor will they divulge it, or allow it to be used or disclosed. They will destroy or return instantly for any reason and / or means, when in the performance of contracted services and in accordance with the terms and conditions of the Terms and Conditions, General Conditions and Special Conditions have access to information on any of the following customer class. In any case it will be applicable the rules applicable in this respect.


8. Applicable law and Jurisdiction


All discrepancies, claims and controversies that may arise are submitted to the Courts and Tribunals of the European Union in the city of Madrid, for cases of dispositive matters, and for matters not dispositive to the legally established jurisdiction.


Spanish law will apply.
