Position Overview

The American Immigration Council is dedicated to enhancing the United States by influencing perceptions and actions towards immigrants and immigration, striving for a more equitable immigration system that provides refuge to those in need and harnesses the talents and abilities that immigrants contribute.

Role Summary

The Senior Litigation Attorney or Litigation Staff Attorney will collaborate with the Legal Director, fellow attorneys, the Council's Policy Team, Paralegals, and Legal Assistants to engage in litigation and legal advocacy across a wide range of topics, which may encompass the right to legal representation, asylum regulations, immigration court matters, and border enforcement issues.

Key Responsibilities

  • Engage in impactful litigation in Federal Court, including:
  • Initiating lawsuits
  • Drafting legal briefs, pleadings, and motions
  • Conducting discovery processes
  • Arguing motions and appeals

Participate in formulating the Council's litigation strategy and develop new legal actions. Prepare and submit amicus briefs to federal courts and agencies. Provide legal counsel and research support to other departments within the Council, including policy and communications teams. Draft practice advisories and other resources for immigration practitioners. Offer training and practical assistance to immigration professionals. Foster partnerships with AILA, law firms, and other collaborative organizations. Engage in working groups and coalitions to further the Council's objectives. Act as a spokesperson for the Council on selected matters. Organize and participate in litigation meetings. Write and edit blog posts, Council publications, website content, and other non-legal documents. Supervise interns, fellows, and attorneys as needed (for the senior litigation attorney role). Undertake additional duties as assigned by the Legal Director or Deputy Legal Director.

Travel Requirements

Some travel is anticipated for this role, typically 4-8 times annually, which may include attending hearings, Council training sessions, board meetings, and conferences.

Qualifications

  • J.D. Degree is mandatory.
  • Admission to any State Bar is required.

Desired Qualifications

  • Legal experience:
  • For the Litigation Staff Attorney role: Minimum of 3 years of legal experience in federal litigation or immigration law.
  • For the Senior Litigation Attorney role: At least 10 years of legal experience, with a minimum of 5 years in federal court litigation. Experience should include drafting pleadings, motions, and briefs; conducting discovery; and oral advocacy.
  • Experience working collaboratively in a team environment and across organizations.
  • Experience presenting at conferences and gatherings.
  • Ability to devise creative solutions to legal challenges.
  • Strong written and verbal communication skills.
  • Excellent analytical abilities.

Knowledge Requirements

  • In-depth knowledge of immigration law and policy, particularly regarding immigration enforcement and removal processes, as well as the immigration court system.
  • Litigation experience:
  • For the Litigation Staff Attorney role: Preferred experience in federal court litigation and class action cases.
  • For the Senior Litigation Attorney role: Required experience of at least 5 years in federal court, with class action litigation experience preferred.
  • Spanish language proficiency is preferred.
  • Exposure to non-profit and governmental environments is advantageous.

  • Proficiency in Microsoft Office Suite (specifically Word, Excel, Outlook, and PowerPoint).

  • Ability to succinctly summarize complex information for policymakers, the media, and the public.

Compensation

The annual base salary for the Senior Litigation Attorney is $110,000, while the Litigation Staff Attorney position offers an annual base salary of $98,000.
