Role Summary

The Litigation Staff Attorney or Senior Litigation Attorney will collaborate closely with the Legal Director, other members of the Legal Team, the Council's Policy Team, as well as Paralegals and Legal Assistants to engage in litigation and legal advocacy across a wide range of issues, including the right to legal representation, asylum regulations, immigration court matters, and border enforcement policies.

All positions at the Council necessitate a strong commitment to the organization's mission and a culture of philanthropy.

Key Responsibilities

  • Engage in impactful litigation within Federal Courts, which includes:
  • Initiating lawsuits
  • Composing briefs, pleadings, and motions
  • Conducting discovery processes
  • Arguing motions and appeals

Contribute to the development of the Council's litigation strategy and identify new litigation opportunities.

Draft and submit amicus briefs to federal courts and agencies.

Provide legal guidance and research support to various departments within the Council, including policy and communications.

Create practice advisories and other litigation resources for immigration professionals.

Offer training and practical assistance to immigration practitioners.

Encourage collaboration with AILA, law firms, and other partner organizations.

Participate in working groups and coalitions to further the Council's objectives.

Act as a spokesperson for the Council on selected matters.

Organize and engage in litigation meetings.

Compose and revise blog posts, Council publications, website content, and other non-legal documents.

Supervise interns, fellows, and attorneys as necessary (for the senior litigation attorney role).

Perform additional duties as assigned by the Legal Director or Deputy Legal Director.

Some travel may be required for this position, typically 4-8 times annually, which may include attending hearings, Council trainings, board meetings, and conferences.

Qualifications

J.D. Degree is mandatory.

Admission to any State Bar is required.

Preferred Qualifications:

  • A solid understanding and commitment to the Council's mission and values.
  • Legal experience:
  • For the litigation staff attorney role: Minimum of 3 years of legal experience in federal litigation or immigration law.
  • For the senior litigation attorney role: At least 10 years of legal experience, with a minimum of 5 years in federal court litigation. This experience should encompass drafting pleadings, motions, and briefs; conducting discovery; and oral advocacy.
  • Experience working collaboratively in a team environment and across organizations.
  • Experience presenting at conferences and gatherings.
  • Ability to creatively approach legal challenges.
  • Strong written and verbal communication skills.
  • Excellent analytical abilities.

Knowledge Requirements

  • Familiarity with immigration law and policy related to enforcement and removal, as well as the immigration court system.
  • Litigation experience:
  • For the litigation staff attorney role: Preference for federal court litigation and class action experience.
  • For the senior litigation attorney role: Required federal court experience of at least 5 years, with class action litigation experience preferred.
  • Spanish language proficiency is preferred.
  • Experience in non-profit and government environments is advantageous.

The annual base salary for the Senior Litigation Attorney is $110,000, while the Litigation Staff Attorney position offers a base salary of $98,000.
