Primary Function:

Under the guidance of the Superintendent, the General Counsel provides comprehensive legal support to the Superintendent, designated personnel, and the Board of Trustees. This role includes legal representation, research, and ensuring compliance with legal obligations. The General Counsel also collaborates with the Superintendent's Cabinet to address legal matters affecting the district.

Key Responsibilities:

Legal Services

  • Advises the Superintendent, designated staff, and Board on legal matters concerning governance, employment, business operations, construction projects, real estate transactions, inter-agency contracts, student discipline, and special education.
  • Represents the district in administrative and judicial proceedings as necessary.
  • Drafts, reviews, and modifies legal documents, including contracts and resolutions.
  • Collaborates with district personnel to create, review, and update district policies and administrative regulations.
  • Reviews board meeting agendas prior to publication.
  • Attends board meetings and other administrative gatherings to provide legal counsel to the Superintendent, Board of Trustees, and designated staff.
  • Coordinates legal services from external law firms, managing contracts and reviewing invoices.
  • Works closely with the Assistant Superintendent of Human Resources to offer legal support for student, parent, community, and employee grievances, complaints, and appeals as required by policy.
  • Ensures compliance with federal and state laws, including the Texas Public Information Act and the Texas Open Meetings Act.
  • Conducts legal analysis for the development and execution of guidelines and updates materials for publication in relevant manuals and handbooks.
  • Manages responses to investigations by regulatory agencies, as appropriate.
  • Provides legal guidance on district elections.
  • Assists in formulating the district's legislative agenda and offers legislative services to advance this agenda.
  • Monitors and interprets the implications of proposed or enacted legislation.
  • Conducts professional development training, including preparing training materials for staff and Board members.
  • Assists in the compilation, maintenance, and filing of all required reports, records, and documents.
  • Supports student and personnel investigations and documentation as necessary.
  • Monitors incoming Public Information Act requests, assists in record collection and responses, and prepares requests for opinions to the Attorney General.

Policy and Reporting

  • Assists in the development and implementation of policies and regulations, reviewing materials for handbooks.
  • Compiles, maintains, and presents all necessary reports and records.
  • Adheres to district safety protocols and emergency procedures.

Personnel Management

  • Supervises and evaluates the performance of the assigned Administrative Assistant.

Other Responsibilities

Education/Qualifications:

  • Juris Doctor degree from an American Bar Association-accredited law school.
  • Licensed to practice law in the State of Texas.
  • A minimum of three years of experience in public or private practice addressing legal issues relevant to local, state, and federal government, preferably with a focus on public school law.
