Non-Competitive Appointment:
For non-competitive appointment, candidates must have

EITHER:

  • Two years of permanent, non-competitive service as an Investigative Officer 2 (Professional Conduct), OR
  • Nine years of experience in conducting field investigations or inquiries into professional or medical misconduct prior to civil litigation or criminal prosecution. This experience must include conducting interviews of witnesses and others; preparing comprehensive reports of investigative findings; and testifying at administrative or criminal proceedings. Three years of the experience must have been at a supervisory level.

SUBSTITUTION:
An Associate's degree in criminal justice or a related field may substitute for two years of qualifying experience. A bachelor's degree in criminal justice or a related field may substitute for four years of qualifying experience.

Related fields include law enforcement, police science, criminal justice, administration, criminology, criminal investigation, police studies, public justice, forensic accounting, forensic psychology, forensic science, economic crime management, and homeland security.


Duties Description: The New York State Education Department's Office of Education Policy is seeking candidates for a Senior Investigative Officer (Professional Conduct) position in the Office of School Personnel Review and Accountability.

This Office is responsible for preparing and prosecuting cases against educators and school administrators who lack the moral character to hold such credentials pursuant to Education Law.

The Office is also responsible for making determinations concerning whether employment clearances for school district employees should be issued based upon fingerprint-supported criminal history background checks.

Duties of this position include, but are not limited to, the following:

  • Supervising investigators and moral character cases to ensure that there is legally sufficient evidence and that investigations are conducted in a timely and thorough manner;
  • Interacting with school attorneys and other school personnel on moral character, fingerprinting, and tenure issues;
  • Overseeing the criminal history background check process, resolving day-to-day technical problems, and handling complex customer complaints;
  • Supervising fingerprint processing support staff;
  • Reviewing all cases recommended for closure without action with subordinate staff to ensure that closure is the appropriate outcome considering the conduct alleged, the legal sufficiency of the evidence, and the likelihood of prosecutorial success;
  • Negotiating and overseeing vendor contracts;
  • Serving as liaison to vendors/agencies including court reporters, fingerprint interfaces, national educator identification clearinghouse, and the Division of Criminal Justice Services;
  • Assisting in the management of the office including operations, policy, personnel decisions, supervision, troubleshooting, customer service, IT issues, planning, and decision-making;
  • Producing and managing office reports for fingerprint operations and investigative operations;
  • Assisting in the management of the teacher tenure hearing process; and
  • Performing other duties as needed or assigned by the Director.
CONDITIONS OF EMPLOYMENT:
This will be a permanent, non-competitive appointment. Promotions and transfers may change appointees' negotiating unit. Candidates should be aware that changes in negotiating units may affect their salary, insurance, and other benefits. Verification of work experience will be required at the time of interview for all candidates. This position requires 1% statewide travel. Fingerprinting through the Federal Bureau of Investigation and the Division of Criminal Justice Services is required for employment. Fees associated with this process are at the Department's expense.
