ABOUT OATH

The City of New York's Office of Administrative Trials and Hearings (OATH) stands as the largest administrative tribunal in the nation, conducting approximately 220,000 trials and hearings annually. As the City’s independent administrative law court, OATH adjudicates a diverse array of matters submitted by nearly every city agency, board, and commission. Additionally, OATH encompasses the Center for Creative Conflict Resolution, which offers mediation and restorative justice services to City government agencies and the public, along with the Administrative Judicial Institute, a resource center dedicated to training, continuing education, research, and support for administrative law judges and hearing officers.

POSITION SUMMARY

The Hearings Division of OATH is responsible for conducting hearings related to civil enforcement summonses, which include health, safety, and quality of life issues filed by various City agencies such as the Department of Buildings, Department of Sanitation, Fire Department, Department of Environmental Protection, Taxi and Limousine Commission, Department of Consumer and Worker Protection, and the Department of Health and Mental Hygiene. The Hearings Division manages up to 1,000 hearings daily, addressing the hundreds of thousands of summonses submitted to OATH each year.

OATH is in search of a Deputy Commissioner for Hearings to lead the Hearings Division, which includes a team of full-time attorneys and support staff, as well as a substantial roster of per session Judicial Hearing Officers. Reporting directly to the Commissioner and Chief Administrative Law Judge, the ideal candidate will possess extensive legal and executive experience, demonstrating a proven ability to lead and manage teams, oversee high-volume operations, delegate and supervise complex tasks, innovate solutions, and collaborate effectively with leadership.

Key Responsibilities

  • Uphold the agency's mission while ensuring the integrity of the hearings process.
  • Oversee the hearings process to guarantee that all parties receive fair hearings and timely decisions.
  • Manage daily hearings operations, including the assignment of cases to adjudicators and addressing any issues that may arise with respondents.
  • Review and update existing rules, protocols, and procedures for Division operations, proposing changes as necessary.
  • Collaborate closely with the leadership of the OATH Clerks Office on matters affecting hearings.
  • Liaise with other Deputy Commissioners and city agencies regarding issues impacting the Division.
  • Advise the Commissioner and Chief Administrative Law Judge on a wide range of questions and issues related to the Division and the agency.
  • Supervise all Division staff.
  • Recruit and train attorneys and Judicial Hearing Officers for the Division.
  • Manage special assignments and projects as required.

Qualifications

Applicants must be admitted to the New York State Bar and possess four years of recent, full-time, relevant legal experience following admission to any bar, with at least eighteen months in a supervisory role over other attorneys, in an administrative, managerial, or executive capacity, or performing highly complex and significant legal work. Incumbents are required to maintain their membership in the New York State Bar in good standing throughout their employment.
