Additionally, OATH is home to the Center for Creative Conflict Resolution, which offers mediation and restorative justice services to City government agencies and the public, as well as the Administrative Judicial Institute, a resource center dedicated to training, continuing education, research, and support for administrative law judges and hearing officers.


POSITION SUMMARY:


OATH is looking to appoint a Lead Special Education Hearing Officer to oversee the administration of special education impartial due process hearings for students with disabilities aged 3-21, in accordance with section 200.1(x) of the Regulations of the Commissioner of Education and Section 504 of the federal Rehabilitation Act of 1973, as amended.

The Lead Special Education Hearing Officer will collaborate with the Deputy Commissioner of the Division to supervise all adjudicatory functions related to the impartial hearing process for parents, guardians, or school districts seeking relief under the Individuals with Disabilities Education Act (IDEA) and/or Section 504, serving as a senior advisor on policy and legal issues.


The IDEA has established due process protocols for instances when a parent and a school district disagree regarding the identification, evaluation, educational placement, or provision of a free appropriate public education for a student with a disability.

Such disputes may be resolved through an impartial hearing, a formal process in which the parties present and contest evidence before a hearing officer.

Responsibilities will encompass, but are not limited to:

  • Oversee all pre- and post-hearing adjudicatory activities to ensure timely determinations regarding students' services.
Monitor the activities and timelines involved in cases managed by Special Education Hearing Officers.

  • Ensure compliance with federal and state laws and regulations under the IDEA and Section 504 of the Rehabilitation Act.
  • Assist in the preparation and coordination of necessary notices and documentation to uphold full due process rights for students with disabilities.
  • Act as a continuous training and educational resource for Special Education Hearing Officers regarding updates in federal and state laws, regulations, and court decisions.
  • Responsible for generating public-facing analyses and reports for elected officials, media outlets, families, and communities.
  • Conduct hearings via remote means and in person, evaluating evidence and maintaining administrative courtroom procedures.
  • Facilitate settlement discussions between parents and the New York City Department of Education.
  • Issue written determinations.
  • Conduct legal research concerning state and federal education laws, the IDEA, and special education programs.
  • Manage special assignments and projects, including oral and/or written presentations.
  • Maintain a high standard of professionalism and efficiency in ensuring that assigned matters are addressed promptly.


Training for New York State Education Department impartial hearing officers will be provided at no cost to candidates following hiring.

OATH Lead Special Education Hearing Officers are appointed for a term of four years, with the possibility of reappointment.

Qualifications:


Admission to the New York State Bar; and four years of recent full-time responsible, relevant, satisfactory legal experience following admission to any bar, with at least eighteen months in a supervisory role over other attorneys, in an administrative, managerial, or executive capacity, or performing highly complex and significant legal work.


Incumbents must remain members of the New York State Bar in good standing throughout their employment.
