Minimum Qualifications and Requirements:
  • Juris Doctorate degree from an accredited institution and admission with good standing to the NH state Bar
Preferred Qualifications:
  • Experience in Special Education Law or willingness to participate in training
  • 2-5 years law practice experience in Education, Policy, Contracts, Employment and/or Labor law
Core Function: To provide comprehensive, full-time professional legal counsel, policy recommendations, and representation to the Superintendent, staff, and the Board of School Committee on matters pertaining to the school district. Participate as a key member of the Superintendent's Educational Leadership Team.

Key Responsibilities:
  • Prepare and conduct litigation and administrative law hearings as directed by the Superintendent and authorized by the Board of School Committee, including the preparation of all pleadings and trial and appellate briefs, negotiation between parties, and the conduct of trials and hearings at the level of original jurisdiction or on appeal, ensuring effective representation of the school district's interests.
  • Collaborate closely with contract legal counsel on complex matters and insurance litigation.
  • Provide legal opinions upon request to the Superintendent, staff, and the Board of School Committee.
  • Review and prepare all invitations to bid and legal contracts for the Board of School Committee.
  • Draft and review all Board policies and procedures for the Board of School Committee.
  • Advise the Board of School Committee on legal or technical matters relating to statutes, charters, ordinances, contracts, and parliamentary procedures.
  • Assist the Board of School Committee in staff contract negotiations.
  • Attend all meetings of the Board of School Committee as required.
  • Provide legal assistance in drafting legal documents, rules and regulations, resolutions, applications, and other legal or quasi-legal papers upon request.
  • Maintain a current file of all legislation introduced in the state legislature and interpret its impact on the school district.
  • Assist in drafting state legislation proposed by the school district for presentation to the state legislature.
  • Prepare and represent the Board of School Committee in disciplinary proceedings against tenured teachers and administrators.
  • Represent the Board of School Committee in matters concerning discipline and dismissal of teaching and non-teaching employees, including termination of probationary employees and related grievance and arbitration hearings.
  • Negotiate with certified bargaining units to achieve mutually satisfactory agreements on wages, hours, and working conditions.
  • Interpret the powers and duties of the Board of School Committee in administering their statutory and constitutionally authorized responsibilities.
  • Review investigations and advise the Superintendent on prospective discipline and contract implications.
  • Work closely with staff on compliance matters related to special education.
Position Specifications: This is a non-affiliated full-time position, 228 days per year.
