Position Overview:
This role is situated within a bargaining unit.

Work Requirements:
  • Mandatory onsite presence for a minimum of five days within a two-week pay cycle.

The incumbent will independently assess assigned cases to ensure the completeness of the briefing schedule, verify the absence of pending motions, and confirm that all pertinent documents necessary for the appeal's resolution are included in the case record.

Extensive research on statutes, regulations, judicial decisions, legislative history, and other legal sources will be conducted to analyze the legal points involved, providing a coherent examination of each case, addressing relevant issues and evidence.

The role involves advising the Board, utilizing existing precedents, or logically applying statutory construction rules to formulate a reasoned analysis of the factual or legal questions presented.

Support for oral arguments in unique cases where parties present before the Board may be required; recommendations to the Board will be made through written memoranda or outlines discussed during oral presentations; drafting of written decisions and orders will align with the Board Members' instructions and votes; assistance in preparing dissenting or concurring opinions, particularly in complex cases, may also be necessary; revisions of decisions and orders will be executed as directed, culminating in a final decision and order for Board approval and signature.

The incumbent will mentor junior attorney staff, providing guidance in case development and processing, as well as in drafting memoranda and decisions; a technical review of lower-grade attorney work products may be performed to ensure final decisions are formatted correctly and devoid of typographical errors.

Coordination of work or project assignments, monitoring ongoing case work, identifying and resolving potential issues that could hinder case completion, and reviewing the final outputs of the group to ensure legal quality and consistency with policy are essential functions.

Acting as a liaison to the Clerk's Office, the incumbent will provide legal insights and advice to assist in preparing cases for processing.

Maintaining accurate records of case assignments, due dates, and other relevant information is crucial for ensuring timely case assignment and processing.

On an ongoing basis, the appropriate classification (Type I, II, or III) for cases referred to the Office of General Counsel will be determined, assessing cases based on complexity, novelty, the number of issues presented, and the estimated time required for drafting decisions or orders.

Alerting the Associate General Counsel to potential complex or novel issues is necessary, along with assigning cases to staff attorneys to ensure timely resolution.

Guidance and instruction will be provided to newly assigned attorneys regarding style, critical legal points, precedents, and general Board policy.

Special projects may be assigned, including the development, compilation, or revision of policy and procedural directives, instructional materials for legal research references, and staff training aids.

Requirements:
Applicants must be at least 16 years old and a U.S. Citizen. A trial period may be required if not previously met. A background investigation may be necessary for appointment to this position.Qualifications:
To qualify, applicants must possess a professional law degree (LL.B. or J.D.) and be a member in good standing of the bar of a court of general jurisdiction of a state, territory, or possession of the U.S. Additionally, applicants must have three years of progressively responsible legal experience post-law school, demonstrating the ability to perform at this level, with at least one year of specialized experience in relevant legal areas.Specialized Experience:
Experience with the Black Lung Benefits Act, the Longshore and Harbor Workers' Compensation Act, or similar litigation experience through appellate or federal law is required. Candidates should demonstrate experience in independently reviewing and analyzing cases, making recommendations, and drafting legal opinions or arguments.Documentation:
Applicants must provide a Bar Certificate, law school transcripts, and an unedited legal writing sample not exceeding ten pages to be considered for this position.Education:
An LL.B or J.D. is mandatory for this role. Failure to submit sufficient academic documentation will result in an incomplete application and ineligibility for further consideration.Additional Information:
