Work Requirements:
- This position mandates a minimum of five days of onsite work within a two-week pay period.
The incumbent will:
- Conduct independent reviews of assigned cases to ensure completeness of briefing schedules, absence of outstanding motions, and inclusion of all pertinent documents for appeal resolution.
- Engage in comprehensive research of statutes, regulations, judicial decisions, legislative history, and other legal sources pertinent to the legal issues at hand, providing a structured analysis of each case.
- Offer advisory support to the Board, utilizing existing precedents or applying statutory interpretation rules to formulate a well-reasoned analysis of the factual or legal matters presented.
- Support and potentially attend oral arguments in unique cases before the Board, making case recommendations through written memoranda or outlines discussed during presentations; draft written decisions and orders in accordance with Board Members' directives.
- Mentor junior attorney staff, providing guidance in case development, processing, and drafting of legal documents; perform technical reviews of their work products to ensure legal quality and adherence to policy.
- Coordinate project assignments, monitor ongoing case work, identify and address potential issues affecting case completion, and review final outputs for legal consistency and quality.
- Act as a liaison to the Clerk's Office, offering legal insights and advice to facilitate case preparation.
- Maintain accurate records of case assignments, deadlines, and other critical information to ensure timely processing.
- Assess the appropriate classification for cases referred to the Office of General Counsel based on complexity and estimated preparation time.
- Provide counsel and instruction to newly assigned attorneys regarding legal style, critical legal points, precedents, and Board policies.
- May undertake special projects such as developing policy directives, instructional materials for legal research, and training aids for staff.
To qualify for this attorney position, candidates must possess:
- A professional law degree (LL.B. or J.D.) and be a member in good standing of the bar of a court of general jurisdiction.
- For the GS-14 grade level, a minimum of three years of progressively responsible legal experience post-law school, demonstrating the ability to perform at this level, including at least one year of specialized experience.
- Specialized experience should include a working knowledge of the Black Lung Benefits Act, the Longshore and Harbor Workers' Compensation Act, or similar litigation experience.
- Experience in independently reviewing and analyzing cases, making recommendations, and drafting legal opinions or arguments.
Applicants must submit:
- A Bar Certificate confirming membership in good standing.
- A copy of law school transcripts for consideration.
- An unedited legal writing sample, not exceeding ten pages, for further evaluation.
