DutiesProvides or directs the provision of all required functions for the successful implementation and administration of awards under the Act. Awards include contracts, compacts, funding agreements, grants, and cooperative agreements.
May at the discretion of the Area Director and IHS Director, serve as Agency Lead Negotiator for Indian Health Service resources for Title V Compacts and Funding Agreements in the Alaska Area. Determines roles and responsibilities for the IHS negotiation team members. Responsible for the coordination and preparation of the agency team for negotiations.
Either performs as ALN, or assists ALN with the following:
Presents the agency policy positions at negotiations of Title V Compacts and Funding Agreements. Negotiates elements of the Title I Annual Funding Agreements and compact and Funding Agreements as permitted by law. Communicates the scope of agency programs, functions, services, and activities (PSFA) with tribes.
Coordinates internal IHS negotiations for the Alaska Area. Confers with the Area Director; the Director, IHS Office of Tribal Self Governance (OTSG); and the Assistant Regional Counsel, Office of General Counsel, DHHS; and, Alaska Area Leadership Team to establish negotiation team(s) and develop negotiation positions/strategies on Title V Compacts and Funding Agreements.
Coordinates the negotiation team(s) including assignments to prepare materials for use in negotiations. Identifies unresolved issues in pre-negotiations, and assigns agency staff and resources to address issues. Provides expertise and advice to solve problems, resolve critical issues, and assure preparedness for negotiations. Distributes pre-negotiation summaries to appropriate parties. Confers with the Office of the IHS Director, Area Director, Office of General Counsel, IHS Headquarters Office Directors and other key staff, Area Leadership staff and others as needed, prior to and during the negotiation process to obtain clarification on issues under negotiation.
Coordinates the review of proposed Funding Agreements (FA) by the proposal review panel (Title I) or IHS negotiation team (Title V) and works to coordinate follow up of the review team's recommendations.
Directs the follow-up activities for the Area after negotiations and agreements with tribes and tribal organizations are in effect. Directs the completion of FA amendments, including entries into IHS database, to be certain they are within funds available and other authority to amend the FA.
Assures that all parties understand and agree with the negotiated compact and Funding Agreement. Certifies the final document as complete and accurate and recommends signature by the Area Director on behalf of the IHS. Coordinates agency responsibilities with Acquisition Management and Financial Management regarding payments to contractors and compactors and with Human Resources regarding assignment of federal personnel to contractors and compactors.
Responsible for the management of the Contract Support Cost (CSC) funds and CSC database for the Area. Tracks or oversees the tracking of CSC requirements for all Title I and Title V tribes and tribal organizations including the preparation of an annual, public CSC shortfall report and the determination of CSC requirements for new and expanded tribally managed programs.
Consults with tribal leaders, tribal health program directors, tribal financial managers and IHS personnel to assure maximum input and participation on CSC issues. As needed, negotiates on behalf of IHS indirect-like costs to be recognized by IHS i n lieu of an established indirect cost rate.
Oversees the Contracting Officer Representative function for Title I contracts; this includes facilitating the provision of technical assistance on tribal PSFA management.
Independently provides the DHHS Office of General Counsel background and other information for their Alaska Area work related to tribes and tribal organizations.
Serves as a senior advisor to the Area Director and policy analyst on issues related to the Act and relationships with Alaska tribes and tribal organizations.
Negotiates dollar amounts the government will be obligated to pay in response to proposals made under the Act.
Upon completion of negotiations, provides written reports of any unresolved issues(s) plus a summary analysis and recommendations to the appropriate agency official(s) or individual(s) which may include: 1) the Director, IHS; 2) the Area Director; 3) Director, OTSG; and, 4) the Office of General Counsel.
Develops a plan of technical assistance to overcome the declination of Title I proposals or in response to Title V final offers. Provides proposed response to final offers.
Provides consultation and training related to self-determination to other agency and tribal entities as requested by the Alaska Area Director.

Your resume must demonstrate at least one (1) year of specialized experience equivalent to at least the next lower grade level in the Federal service obtained in either the private or public sector performing the following type of work and/or tasks: Demonstrated experience and expertise as a negotiator for Public Law 93-638 activities or comparable experience negotiating, awarding and administering formal agreements, e.g., contracts, grants, cooperative agreements, interagency agreements and memoranda of agreements; formulating policies and developing guidelines for processes relating to the successful implementation of Title I and V of Public Law 93-638; and directing the review of contracts, compacts, and funding agreements.Time In Grade
