POSITION SUMMARY


The Tribal Court is a dynamic, exciting place to work for those interested in justice systems and administration.  The function of a court clerk is to assist in the administration of the court to ensure it runs smoothly. Under the administrative direction of the Tribal Court Director, the Clerk of the Court follows the Tribal Court’s policy and procedures, ensuring cases are managed efficiently, completes all required financial reporting, performs record maintenance and provides court patrons with excellent customer service care. Performs other duties as requested by Tribal Court Director and Chief Judge.  This is an entry level position with the greatest focus on learning and application of Clerk of the Court skills.


ESSENTIAL FUNCTIONS


Nothing in this specification restricts management’s rights to assign or reassign duties and responsibilities to this job at any time.

 

  1. Attend sessions of the Tribal Court;
  2. Enter, under the direction of the Tribal Court, all orders, judgments and decrees required to be entered, the title of each proceeding or action, the date of filing such proceeding or action with the Tribal Court, and a memorandum of all subsequent proceedings, with the date and the fees charged;
  3. Accept, under the direction of the Tribal Court, completed documents for filing with the Tribal Court and provide file-stamped records of the same documents to the parties.
  4. Keep a schedule of fees charged in proceedings and actions;
  5. Collect fines, fees and other monies imposed or charged by the Tribal Court, deposit such monies into the proper account of the Tribal Court, and account for the receipt and deposit of such monies;
  6. Provide forms, rules and provide referrals to self-help center services. Answering specific questions about process, form complaints, petitions, answers, motions and other pleadings and documents for proceedings before the Tribal Court, subject to the prohibitions of this Chapter, including prohibitions on giving advice on question of law;
  7. Maintain Chief Judge’s calendar and prepare daily schedule. Schedules and confirms hearing, trials, etc. for Chief Judge and all parties, experts and witnesses and schedules visitors.
  8. Prepare and send notifications of all hearings, meetings, sessions to all mandatory parties; note Clerk shall not personally serve documents to individuals when outside the confines of the Trial Administration Building but shall use other methods such as US mail, electronic mail, Tribal Police service and other such means of communication;
  9. Enters case data into Tribal Court’s database;
  10. Arrange meetings as required or as requested by supervisor.
  11. Assist and gives the general public information pertaining to court matters, filing of documents and procedures;
  12. Keep and maintain such other books of record required by law or rule of the Tribal Court;
  13. Demonstrate understanding of difference between legal advice and legal information;
  14. Receive and screen visitors and telephone calls, directing visitors or callers to appropriate Tribal Court staff;
  15. Represent the Tribal Court with dignity, integrity and a spirit of cooperation in all relationships with staff and the public.
  16. At all times communicate clearly and effectively in English, both orally and in writing.
  17. Performs other duties as assigned by Director or Chief Judge.

SAFETY


  1. Supports a safe work environment by performing all duties in accordance with Tribal safety policies and procedures. This includes, but is not limited to: reporting all incidents and accidents to your supervisor timely (within 24 hours); maintaining work areas in a safe and healthful manner; reporting and correcting any unsafe working conditions; operating vehicles in a safe and lawful manner while conducting Tribal business; providing input and assistance to reduce or eliminate workplace hazards; actively supporting ongoing safety efforts, including recommendations of the safety committee.
  2. Due to the nature of interactions with other employees and the public we serve, employees may be required to provide documentation of, or receive, certain health vaccinations.

 


MINIMUM QUALIFICATIONS

 

  1. Possession of a high school diploma or equivalent.
  2. Must have excellent computer skills including word processing and ability to learn the Microsoft office programs and adobe acrobat.
  3. Office work experience within the last two years.
  4. Ability to interact with the public and provide assistance to those seeking to file documents with the Tribal Court.
  5. Demonstrated ability to exercise self-control to maintain confidentiality in the course of work.
  6. Demonstrated ability to maintain attention to detail.
  7. Ability to organize and prioritize own work to meet deadlines.
  8. Ability to follow chain of command. Establish and maintain effective working relationships with all levels of staff, as well as representatives from other tribal departments, outside agencies and the public.
  9. Legal secretary training or paralegal certificate preferred.
  10. Must maintain a valid CA driver’s license or obtain one upon hire, qualify for the Tribe’s vehicle insurance, and provide proof of personal vehicle insurance.


NATIVE PREFERENCE


Preference in hiring is given to either the most qualified applicant or a Native American candidate who meets the minimum qualifications. When two (2) or more Native American candidates have comparable qualifications, the following order of preference shall apply: (1) Members of Shingle Springs Band of Miwok Indians; (2) Spouses or domestic partners (certified through Tribal Court) of members of Shingle Springs Band of Miwok Indians; (3) Parents of children of the Shingle Springs Band of Miwok Indians; (4) All other documented Native Americans; (5) All other applicants in accordance with Title 25, U.S. Code, Section 472 and 473. Applicants claiming Native preference must submit verification of Indian eligibility.
