The incumbent initiates rulemaking proceedings on major policy matters; reviews and recommends action on petitions for rulemaking submitted to the Commission. The incumbent prepares notices of inquiry and rulemaking; analyzes comments and reply comments, and prepares Commission orders and decisions for these proceedings. Such rulemakings require an understanding of the frequency allocation process and related rules, and typically entail analyzing the existing uses of frequency bands and applying procedures for relocating incumbent operators, when appropriate. The incumbent is also responsible for ensuring that documents are legally and factually adequate, complete, comprehensive, internally consistent, and in conformance with existing policy, precedent, and relevant decisions.

The incumbent is assigned to work on projects for which there is little in the way of existing precedent; for which existing precedent is not clearly analogous (such as application of a rule or policy to a new type of service); or that involve numerous factual and legal disputes among different parties that have arisen within multiple dockets over a long time period. As a consequence, the incumbent is responsible for developing each assignment himself/herself by analyzing the material submitted in the proceeding as well as other pertinent material, evaluating such material, conducting legal and other research, and writing a variety of internal and external documents in a cogent, logical, and well documented form. Incumbent must be able to develop a work plan for the project, and must identify and account for legal or administrative barriers that could frustrate completion of the task ( such as, for example, the need to seek additional notice prior to adopting a proposal). In so doing, the incumbent must often coordinate efforts with other Branches or Divisions, and staff offices within the Commission.

In addition to rulemaking functions, the incumbent is assigned special projects. The incumbent serves as an attorney advisor to the Division and Bureau Chiefs on matters for which the Branch has responsibility. Incumbent also may be called upon to serve as an expert advisor to other offices, dispensing expert advice and guidance relative to spectrum allocation.
