About the Retirement Legal Team

The Retirement Legal Team is a cohesive unit consisting of seven attorneys and a legal secretary. This team provides legal counsel to the Retirement Board and the San Francisco Employees' Retirement System (SFERS), which oversees the administration, management, and operation of the City's retirement plans. Their responsibilities encompass asset investment, adjudicating disability benefit claims, and disbursing retirement benefits. SFERS serves around 75,000 members and beneficiaries, managing approximately $35 billion in assets. Additionally, the Retirement Board oversees the San Francisco Deferred Compensation Plan (SFDCP), which includes over 34,000 participants and about $5 billion in assets. The scope of the Retirement Team's work includes a wide range of municipal legal issues affecting the Retirement Board and SFERS, such as pension benefits, investment portfolios, and the SFDCP. The Team also represents SFERS in administrative hearings regarding disability retirement applications for City employees, Community College District, and School District personnel before the California Office of Administrative Hearings, and may defend these administrative decisions in court.

Responsibilities of the Assistant City Attorney

The lead attorney of the Team serves as the general counsel to the Retirement Board and SFERS. Three attorneys focus on providing investment advice and facilitating investment transactions, while three attorneys handle and present cases related to disability benefits. We are looking to fill a position that will split its responsibilities between managing disability benefits cases and providing benefits advice. The following duties are representative of the range of responsibilities assigned and are not exhaustive:

  • Preparing and presenting disability retirement applications in administrative hearings, as well as defending those decisions in court.
  • Providing legal advice on public agency benefits laws and regulations, including issues related to workers' compensation double recovery offsets, the application of the Gilmore rule, death benefits (including beneficiary designations, competing claims from surviving spouses, and necessary estate documents), service credits, and guardianship matters. This advice also encompasses family law codes regarding dissolution and survivorship rights, Qualified Domestic Relations Orders (QDROs), and probate codes concerning powers of attorney and death benefit issues.
  • Responding to subpoenas for benefits-related information.
  • Drafting legislation on retirement-related topics.
  • Reviewing and approving contracts for legal compliance.
  • Conducting formal solicitations for external legal counsel.
Qualifications

Minimum Qualifications

  • Must be licensed to practice law in California.

Desired Qualifications

  • A minimum of four years of experience in civil or administrative litigation, preferably in workers' compensation, disability benefits, or employment law.
  • Experience in advising on public benefits issues.
  • Strong oral and written communication and advocacy skills.
  • Proficient drafting and negotiation skills.
  • Ability to take responsibility quickly and work independently and efficiently.
  • Capacity to manage and balance an active caseload of administrative and advisory matters, with the flexibility to adapt to workload fluctuations.
  • Good judgment, multitasking ability, and meeting deadlines.
  • Strong interpersonal skills and a positive demeanor.

Salary and Benefits
