OAG - Consumer Protection | Senior Legal Counsel |

The Consumer Protection Division of the Office of the Attorney General, representing the State of Texas, is seeking a licensed attorney for a prominent role based in Austin.

This attorney position is dedicated to the Data Privacy and Security Team.

Key Responsibilities:

  • Focus on the enforcement of Texas's privacy regulations, including the Texas Data Privacy and Security Act (TDPSA).
  • Collaborate with Division attorneys and staff, maintaining regular communication with division management and regulatory bodies.
  • Handle cases comprehensively, from initiation to resolution, which includes issuing Civil Investigative Demands, analyzing documents and evidence, and engaging in litigation.

Essential Duties:

  • Provide legal counsel and assistance to clients and management on factual and legal matters.
  • Engage in administrative and evidentiary hearings, as well as the discovery process.
  • Conduct legal research and investigations, presenting findings and conclusions.
  • Manage all phases of civil litigation related to consumer protection, including drafting legal documents such as petitions, motions, pleadings, orders, briefs, and discovery materials.
  • Represent the Office of the Attorney General in civil matters before state or federal courts.
  • Prepare legal documents and cases for trial.
  • Analyze complex factual and legal issues, developing evidence through witness interviews and other discovery methods.
  • Advise management on relevant factual and legal matters.
  • Assist in drafting legislative bills and amendments.
  • Provide guidance to junior staff and contribute to their training.
  • Maintain current knowledge of legal principles and practices pertinent to Consumer Protection.
  • Ensure compliance with agency policies and procedures, particularly those related to ethics and integrity.

Qualifications:

Minimum Requirements:

  • J.D. from an accredited law school.
  • Four years of full-time experience as a licensed attorney in related fields such as data privacy, privacy compliance, consumer protection, or commercial litigation.
  • Licensed and in good standing with the State Bar of Texas.
  • Strong skills in managing multiple tasks, prioritizing effectively, and meeting deadlines.
  • Excellent oral and written communication abilities.
  • Proficient in legal research, writing, analysis, and problem-solving.

Preferred Qualifications:

  • Eight years of experience in related fields, including oversight of investigations or litigation.
  • Knowledge of relevant laws and legal principles, including the Texas Data Privacy and Security Act and other consumer protection statutes.
  • Experience in complex litigation and jury trials.
