Overview: The City of New York's Department of Correction (DOC) plays a vital role in the evolving landscape of the criminal justice system, engaging in reform initiatives aimed at reducing the jail population while ensuring public safety. Position Summary: The General Counsel's Office is looking for a qualified Agency Attorney Level IV to take on the responsibilities of Records Management Officer and Chief Privacy Officer. Reporting to the Deputy Commissioner for Legal Matters or their designee, this role requires a high degree of independent judgment and initiative. The Records Management Officer will oversee the Department's compliance with Freedom of Information Law (FOIL) requests and serve as the Chief Privacy Officer, interpreting and applying local laws regarding the disclosure of personal identifying information.

Key Responsibilities:

  • Supervise support staff in obtaining and redacting agency records in response to FOIL requests.
  • Track mandatory response deadlines and review FOIL responses prepared by other legal division attorneys.
  • Directly respond to complex FOIL requests and manage challenges related to records denial.
  • Liaise with the City’s Law Department regarding Article 78 challenges and litigation matters.
  • Interpret local laws governing the release of personal identifying information and provide guidance to agency staff.
  • Prepare mandated reports on the disclosure of personal identifying information.
  • Assist in supervising legal staff, including attorneys and support personnel.
  • Conduct legal research and draft complex legal documents as necessary.
  • Advise on legal strategy and participate in settlement discussions.
  • Collaborate with various City agencies and stakeholders to ensure compliance with legal and regulatory requirements.

Minimum Qualifications:

1. Admission to the New York State Bar; and either:

2. One year of satisfactory legal experience in the United States after admission to any state bar; or

3. Six months of satisfactory service as an Agency Attorney Intern.

Maintaining membership in the New York State Bar in good standing is required throughout employment.

Preferred Skills:

  • Experience as an Agency Attorney Level III.
  • At least three years of experience in complex legal work.
  • Expertise in FOIL law and Correction Law, including Section 1983 of the Federal Civil Rights Law.
  • Strong litigation, research, and writing skills.
  • Ability to manage multiple priorities and deadlines effectively.
  • Experience in law enforcement or criminal justice organizations is advantageous.
