Position Summary

We are seeking a Commercial Counsel, Construction & Facilities to manage all legal dimensions of our real estate operations, focusing on construction and facilities management. Your primary responsibilities will include:

  • Construction Oversight: Oversee all legal facets of construction and development projects, including drafting, reviewing, and negotiating contracts with contractors, engineers, and architects. Address issues related to mechanics liens, construction defects, insurance obligations, delays, and associated legal disputes.
  • Vendor Management: Manage agreements and work orders with subcontractors and suppliers related to construction and facilities upkeep.
  • Lease Negotiation: Review, draft, and negotiate leases and licenses, ensuring compliance with landlord stipulations during both construction and operational phases.
  • Site Evaluation: Conduct thorough site evaluations, including zoning assessments, title reports, and environmental studies.
  • Legal Guidance: Provide ongoing legal counsel regarding construction, leasing, facilities maintenance, zoning, and environmental matters.

Qualifications

The ideal candidate will possess a robust background in construction and real estate law, with significant experience in vendor contract management and a comprehensive understanding of leases and construction agreements. Key qualifications include:

  • Juris Doctor (JD) or Master of Laws (LLM)
  • Active member of the New York bar
  • Minimum of 5 years of experience in commercial real estate, particularly in construction within an in-house legal environment
  • Experience in tenant representation, particularly in retail and rapidly growing portfolios
  • Proven ability to manage complex transactions and meet tight deadlines
  • Exceptional drafting, negotiation, and communication skills
  • Innovative problem-solving abilities to achieve business goals and enhance efficiency
  • Familiarity with the restaurant and food industry, retail construction, and environmental health and safety regulations
