Position Summary

We are seeking a Commercial Counsel specializing in Construction & Facilities to manage the legal dimensions of our real estate operations, focusing on construction and facilities management. The successful candidate will be responsible for:

  • Construction and Development: Overseeing all legal facets of construction projects, including drafting, reviewing, and negotiating contracts with contractors, engineers, and architects. Addressing issues such as mechanics liens, construction defects, insurance obligations, and delays.
  • Vendor and Supplier Contracts: Managing agreements with subcontractors and suppliers related to construction and facility upkeep.
  • Lease and License Management: Reviewing and negotiating leases and licenses, ensuring compliance with landlord stipulations during construction and operational phases.
  • Site Due Diligence: Conducting thorough site assessments, including zoning analyses, title investigations, and environmental evaluations.
  • Legal Guidance: Providing ongoing legal support regarding construction, leasing, facilities maintenance, zoning, and environmental matters.

Candidate Profile

The ideal candidate will possess a robust background in construction and real estate law, with a proven track record in vendor contract management and a comprehensive understanding of leases and construction agreements. Key qualifications include:

  • Juris Doctor (JD) or Master of Laws (LLM)
  • Active member of the New York bar
  • Minimum of 5 years of experience in commercial real estate, particularly in construction within an in-house legal setting
  • Experience in tenant representation, especially in retail environments
  • Ability to manage complex transactions and prioritize multiple deadlines
  • Exceptional drafting, negotiation, and communication skills
  • Innovative problem-solving capabilities to achieve business goals
  • Familiarity with the restaurant industry, retail construction, and health and safety regulations
