Qualifications

  • Bachelor’s or master’s degree in an appropriate field required.
  • A minimum of 5 years’ experience in a healthcare organization required.
  • Certified in Healthcare Compliance (CHC) preferred or must obtain certification within 2 years of employment.
  • Supervisory experience required.
  • Current Minnesota Registered Nurse license preferred.
  • Familiar with healthcare laws, the Medicare program, regulations, and standards.
  • Knowledge of reimbursement compliance, auditing and monitoring and performance improvement.

Statement of Position

  • The Compliance Officer provides direction and oversight of the Compliance and Privacy Program.
  • Compliance Officer has a dotted line relationship to the Board of Trustees and may report compliance issues directly to the Board.
  • Establishes and implements an effective compliance and HIPAA privacy program to detect, correct and prevent illegal, unethical, or improper conduct.
  • Works in conjunction with Human Resources to correct staff misconduct.
  • Implements a retaliation-free internal reporting process, including anonymous reporting options
  • Development and maintenance of an Enterprise Risk Management System
  • The Compliance Officer serves as OMC’s HIPAA Privacy Officer and is responsible for ensuring OMC’s compliance with HIPAA and the Minnesota health records act. This includes overseeing patient privacy policies, overseeing the handling of sensitive information and ensuring privacy complaints are investigated.
  • Serves as the Section 1557 of the Affordable Care Act Coordinator
  • Works with the Compliance Committee, organizational and, physician leadership, department supervisors, and directors in an oversight capacity. Is authorized to implement all necessary actions to ensure achievement of the objectives of an effective compliance and HIPAA privacy

Responsibilities

  • Serves as the Chair of the Compliance Committee
  • Is well versed in the federal regulations and works with physician and organizational leadership to assure compliance.
  • Develops, initiates, maintains, and revises policies and procedures for the general operation of the compliance and HIPAA privacy program and related activities, managing day-to-day operation of the programs.
  • Periodically reviews and updates OMC’s Code of Conduct and other compliance-related policies to ensure continuing relevance in providing guidance to leadership and employees.
  • Collaborates with and assists officers, directors, and supervisors to administer the compliance and privacy program.
  • Consults with general counsel as needed to resolve difficult legal compliance issues.
  • Investigates alleged violations of rules, regulations, policies, procedures, and the Code of Conduct and makes independent determinations as to whether a violation occurred.
  • Ensures that all reports of suspected violations and investigations remain confidential.
  • Develops and oversees a system for uniform handling of such violations.
  • In conjunction with Human Resources Department, recommends disciplinary action for code violations as per written policies.
  • Identifies potential areas of compliance/privacy vulnerability and risk, in conjunction with organizational leadership develops and implements corrective action plans for resolution of problematic issues and provides general guidance on how to avoid or deal with similar situations in the future.
  • Provides reports on a regular basis and as directed or requested, keeps the Compliance Committee, board, and senior management informed of the operation and progress of compliance efforts as well as, claims, and claim payments.
  • Ensures proper reporting of violations or potential violations to duly authorized enforcement agencies as appropriate or required.
  • Directs and manages the anonymous compliance reporting systems and departmental web page. Institutes and maintains an effective compliance communication program for the organization, including promoting:
    • Use of the compliance hotline and website for reporting suspected violations
    • Heightened awareness of OMC’s Code of Conduct
    • Understanding new and existing compliance issues and related policies and procedures
  • Develops and facilitates regular and periodic compliance training programs including appropriate introductory training for new employees and ongoing training for all employees and leadership to promote understanding of the code, and corporate compliance. At least Annual training for Board of Trustees members and volunteers.
  • Ensures that all employees receive the code.
  • Assures a file is maintained of all training sessions, attendance at such training sessions.
  • Conducts periodic and regular audits of employees, departments, administration, or offices of Olmsted Medical Center to ensure that they are in compliance with the code.
  • Stays current with changes in state and federal laws, rules, and regulations that may affect the implementation of the programs.
  • Makes recommendations to the CEO and the Board of Trustees of changes in the program that may better facilitate compliance with the code.
