Legal Aid DC seeks applicants to sponsor for an Equal Justice Works and or Skadden Fellowship.  The Fellow will work with the Domestic Violence and Family Law Unit on a project to provide high-quality direct legal services to low-income parents seeking to retain or regain custody of their children from third parties. The Fellow will focus on litigation, outreach, and advocacy with the ultimate goal of ensuring parental rights are adequately recognized and protected by the courts and the law.   

  

Since 1932, Legal Aid has provided civil legal assistance to clients in individual cases and engaged in systemic reform. Currently, we provide individual representation in consumer law, domestic violence/family law, housing, public benefits, and appellate matters. We also work on immigration matters and help individuals with the collateral consequences of their involvement with the criminal justice system. From the experiences of our clients, we identify opportunities for law reform, public policy advocacy, and systemic impact and appellate litigation.

About the Fellowship 

 

Parents – especially low-income parents of color – are often forced to defend their right to parent their children against third parties attempting to take custody. Outside of the neglect system, parents lack a right to counsel to assist them, while entire organizations in DC are devoted to assisting third parties.  At the same time, the protections for parents in DC’s law are often overlooked or misapplied.  The result is, at best, that parents are required to attend repeat court proceedings and defend their private choices to the court and, at worst, that the family is broken up and parents lose custody to a non-parent.   

 

The Fellow will provide direct representation to biological or other legally recognized parents in custody cases in which the parent’s Constitutional parental rights are challenged by a third-party (non-parent).  The Fellow will conduct intake interviews with prospective clients at Legal Aid’s NW and Big Chair SE offices and courthouse offices to identify cases in which a third is involved; provide advice and assess cases for further assistance; and handle a caseload of custody and related family matters representing parents against third parties. The Fellow will conduct in-depth research on the standard for third-party custody across states and -- with the support of the Unit and Legal Aid DC’s Systemic Advocacy Unit and in collaboration with other organizations -- advocate for systemic policy changes to DC’s laws to better protect parents from attempts to break apart families.    In addition to an active litigation docket and ongoing work towards systemic reform, the Fellow will participate in community outreach on issues related to parental rights, both to identify potential clients and to provide generalized “know your rights” trainings.  

 

Legal Aid Fellows primarily work out of our NW office but may also work out of Legal Aid’s community office in SE. The Domestic Violence and Family Law Unit also helps staff one or more of the District’s two Domestic Violence Intake Centers – in NW at the DC Superior Courthouse and in SE at the “Big Chair” office complex in Anacostia –, and the Child Support Resource Center and the Family Law Assistance Network courthouse project offices at DC Superior Court. 

 

Qualifications 

  

Ideal candidates will be law students entering their third year or recent graduates who expect to complete a judicial clerkship in the summer of 2025.  

 

The ideal candidate will have the following:   

  

  • Strong organizational, communication, and leadership skills;   
  • The ability to work skillfully, both independently and collaboratively with teams;   
  • A commitment to public interest and a desire to work in a collaborative work environment;   
  • Ability to multi-task and prioritize assignments;   
  • Bilingual skills and an interest in Domestic Violence and Family law are strongly preferred, but not required.  

 

The selected candidate will work with Legal Aid on fellowship applications to be submitted to the Equal Justice Works/Skadden Foundation in the fall of 2024. The fellowship, if awarded, will begin in the fall of 2025 and is anticipated to last two years. 

 

Salary and Benefits  

 

The Fellow will be paid by applying for outside fellowship funding from either Equal Justice Works or Skadden fellowship programs. Fellowships will only commence if outside funding is granted. If fellowship funding is lower than Legal Aid’s salary scale, Legal Aid will pay the fellow the additional amount to bring them up to the appropriate salary.  

 

The salary for a pre-bar attorney or attorney with less than 1 year of experience is $71,054. The salary for an attorney with 1 year of experience is $73,591.  

 

Legal Aid offers a generous benefits package, including eligibility for fully paid health insurance, annual retirement match, 12 paid holidays, 20 days of annual leave per year and 15 days of sick leave per year.

This position is included in the bargaining unit represented by National Organization of Legal Services Workers, UAW Local 2320.  New hires start with a 90-day probationary period before they are considered full-time, regular employees.
