The Litigation Paralegal provides legal and claims handling support to the Litigation Unit in conjunction with its handling of litigated claims, including, but not limited to: managing small claims court cases, preparing reservation of rights and simple coverage position letters, performing substantive review of letters and correspondence in support of in-house counsel, assisting with investigation and discovery, gathering responsive materials for subpoenas, performing legal research, maintaining litigated claim files, providing scheduling and calendar management for in-house counsel, maintaining Trial/ADR calendars and other Litigation Unit documentation, and ensuring compliance with Litigation Handling Guidelines and timely and accurate reporting requirements. The Litigation Paralegal also acts as liaison to various outside vendors, including outside counsel, legal spend auditors, and registered agents. This position reports directly to the Litigation Manager and supports all in-house counsel.

ESSENTIAL FUNCTIONS

  • Manage small claims cases or other files as assigned.
  • Prepare reservation of rights and coverage position letters in support of in-house counsel.
  • Substantively review drafts of letters and correspondence from in-house counsel for factual accuracy, formatting, spelling, and grammar.
  • Assist in drafting routine pleadings or discovery on behalf of in-house counsel.
  • Assist in the investigation and gathering of documentation for discovery purposes.
  • Assist in responding to subpoenas as required by in-house counsel and/or the Claims Department.
  • Provide scheduling and calendar management for in-house attorneys, liaising with outside counsel as needed.
  • Oversee the Legal Department’s Trial/ADR calendars and documentation of key dates across calendars, claim files, and metrics.
  • Support the Legal Department in the research, analysis, and document gathering for internal business initiatives and Committee functions.
  • Respond accurately and promptly to agent inquiries regarding claims and status updates.
  • Ensure compliance with Litigation Handling Guidelines by outside counsel
  • Provide clerical support to the Legal Department in evaluating, documenting, and negotiating settlement of property and/or casualty claims in suit, including the issuance of settlement checks.
  • Process the handling of expense payment draft requests and settlement checks, ensuring compliance with all regulatory and internal processes.
  • Assist in-house counsel with drafting alerts for file resolutions.
  • Assist in document gathering for production to reinsurers or auditors.
  • Identify and address process inefficiencies to enhance customer service and compliance with internal controls and Company policies.
  • Foster positive relationships with business partners for successful compliance and strategic objectives.
  • Ensure all Medicare fields are completed and accurately documented in the file prior to the issuance of any settlement checks
  • Perform thorough and accurate legal research as assigned for the handling of suit files, publications, and training purposes.
  • Additional duties as assigned.

QUALIFICATIONS

  • Associate’s degree with a certificate in paralegal studies or bachelor’s degree in a similar field.
  • Experience in a corporate legal or law firm environment preferred.
  • Experience in statutory application and tort law defense preferred.
  • Experience with property and casualty liability preferred.
  • Intermediate level proficiency in Microsoft Office including Word, Excel, Power Point, and Outlook.
  • Intermediate level proficiency in Westlaw, Lexis, and/or other on-line legal research services preferred.
  • Ability to read, classify, analyze, interpret, and summarize highly technical information, legal documents, and legal authorities.
  • Maintenance of computer and digital literacy skills as dictated by technological advancement and Company initiatives.
  • Excellent written and verbal communication skills.
  • Attention to detail with a high degree of accuracy.
  • Strong administrative, detail-oriented project management and organizational skills.
  • Strong leadership and customer service skills.
  • Strong analytical, problem-solving, and decision-making skills.
  • Ability to respond to routine inquiries from agents, policyholders, claimants, law firms, and employees.
  • Knowledge of and ability to apply appropriate mathematical functions and perform basic calculations to assure accuracy of claims and law firm invoice payments.
  • Ability to interpret instructions furnished in written, oral, diagram, and schedule form.
  • Proven organizational and time management skills evidenced by ability to meet deadlines effectively and adapt to new priorities.
  • Team oriented with ability to work in collaboration with both legal and business partners.
  • Ability to communicate or provide legal guidance to a diverse audience in a clear and concise manner.
  • Ability to initiate and follow through on tasks with little direction.
  • Ability to demonstrate the highest level of ethical behavior, integrity, initiative, and resilience.
  • Ability to navigate, and in some instances, configure third-party software.
  • Must be a licensed driver and maintain a valid driver’s license in the state of residence.
