Objective of the Office/Department

This position is with the Pan American Health Organization (PAHO), the Regional Office of the World Health Organization (WHO). The Senior Legal Advisor provides legal advice and counsel to PAHO’s Governing Bodies, Executive Management, PAHO/WHO Representatives (PWRs), PAHO Centers, Country Offices, and PASB Headquarters entities on all legal matters. This includes the application of national and international law to the Organization’s programs and activities, as well as constitutional, administrative, and procedural matters. The incumbent drafts, reviews, and negotiates contracts, treaties, agreements, resolutions, and other legal instruments. They also represent and defend the Organization before internal appeals processes and external judicial and quasi-judicial bodies.

Description of Duties

Under the direct supervision of the Legal Counsel, the incumbent’s responsibilities include:

  • Legal Advice:
    • Provide authoritative legal advice on complex legal matters affecting the Organization.
    • Exercise independent judgment and balance technical, legal, and political considerations.
    • Coordinate research and examine precedents to provide legal opinions.
  • Legal Instruments:
    • Prepare, interpret, and review legal instruments such as constitutions, statutes, treaties, and agreements.
    • Ensure that all legal instruments comply with relevant administrative procedures.
  • Representation:
    • Represent the Organization before high-level representatives of Member States and other parties.
    • Participate in joint missions to Member States and provide legal advice in decision-making meetings.
  • Negotiations:
    • Serve as a key contact and negotiator with staff, traditional institutions, partners, contractors, and representatives of donor agencies.
    • Negotiate complex agreements and highly sensitive personnel issues.
  • Supervision:
    • Supervise other attorneys and collaborate with outside counsel as necessary.
    • Select, train, and supervise junior attorneys and support staff.
  • Litigation:
    • Assume direct responsibility for selecting and supervising local lawyers.
    • Prepare and review briefs for proceedings before local courts and administrative tribunals.
  • Strategic Planning:
    • Design and supervise strategies to improve the competency and efficiency of the Office of the Legal Counsel.
    • Recommend changes to take advantage of new legal and regulatory developments.
  • Secretariat Services:
    • Provide secretariat legal services to various committees and bodies.
    • Develop procedures for preparing and processing legal instruments.
  • Leadership:
    • Provide leadership and guidance to supervised staff by setting clear work objectives and ensuring effective use of performance reviews.
    • Promote a learning environment and address interpersonal or technical conflicts.
  • Other Duties:
    • Serve as Acting Legal Counsel during the absence of the Legal Counsel.
    • Perform other related duties as assigned.
Required Qualifications

Education:

  • A bachelor’s degree from a recognized university and a Juris Doctor (J.D.) law degree from an accredited law school.
  • Licensed attorney with admission to practice law in a PAHO Member State.

Experience:

  • Thirteen years of combined national and international experience in a legal office of a public international organization or governmental agency, with emphasis on public international law and/or international administrative legal processes.
  • Managerial experience including supervising attorneys handling cases before national or international judicial and quasi-judicial bodies.

Skills:

  • Extensive expertise in public international law, administrative and commercial law, and the legal structures and principles applicable to international organizations.
  • Theoretical and practical knowledge in comparative and international law, private sector/commercial law, corporate law, corporate governance, administrative law, or litigation.
  • Ability to lead and manage teams of lawyers effectively.
  • Expertise in handling issues related to privileges and immunities of international organizations.
  • Strong written and communication skills, with the ability to present legally sound arguments and influence management and stakeholders.

Languages:

  • Proficiency in English and Spanish.
  • Knowledge of French and/or Portuguese is an asset.

IT Skills:

  • Proficiency in current technology and software, including Microsoft Excel, Outlook, OneDrive, PowerPoint, Teams, SharePoint, and Word.
  • Familiarity with Enterprise Resource Planning (ERP) and management information systems.
Remuneration

Annual Salary: USD $92,731.00 (net of taxes)
Post Adjustment: 70.2% of the above figure, subject to fluctuations due to currency exchange rates or inflation.
