Job Overview:

This role is for an attorney within the Policy Division.

The Policy Division is one of several divisions in the Legal Services Department of the HHS Office of Chief Counsel (OCC).

The Policy Division offers comprehensive legal guidance and assistance to all agencies and programs within the health and human services framework in their operational and policy-related activities, including rule-making processes, enforcement actions, legislative issues, and general agency support.

Policy attorneys engage closely with these agencies and programs, facilitating connections with attorneys from other Legal Services divisions as needed.

During legislative sessions, Policy attorneys play a crucial role by aiding in bill analysis, drafting, and interpretation.

The primary focus of this position is to collaborate with a team that provides legal support to Texas Medicaid and the Children's Health Insurance Program, which serves over 4 million Texans and encompasses complex, impactful areas of both federal and state law.

Teamwork and collaboration with fellow attorneys are highly valued, offering pathways for professional growth and mobility within the Legal Services Department.

The position operates with limited supervision, allowing for significant initiative and independent decision-making.

The responsibilities include overseeing and organizing legal tasks; drafting legal documents; interpreting federal and state legislation; developing, drafting, reviewing, and approving regulations and policies; assessing contracts, grants, data requests, and legislative proposals; providing legal counsel on policy issues; and engaging in negotiations with federal and state agencies and managed care organizations.

The role may also involve offering guidance to colleagues.

Key Responsibilities:
(80%)

Provides legal advice to HHS system clients and OCC leadership on legal issues and the drafting, interpretation, and application of:

agency policies; HHS and other agency regulations in the Texas Administrative Code; state laws, including but not limited to the Government Code and Health and Safety Code; and federal laws and regulations, particularly those related to public health and welfare.

(10%) Assists in the formulation of strategies and programs to implement legislative, programmatic, and policy initiatives.

(10%) Evaluates, analyzes, and drafts legislation that may impact HHS System programs, operations, or policies.

Required Knowledge, Skills, and Abilities:

Familiarity with legal principles, practices, and procedures; knowledge of state and federal laws, rules, and regulations; and understanding of agency administrative rules and regulations.

Proficiency in legal research, writing, and analysis; adeptness in using computers and relevant software; capability in reasoning and logic; skill in identifying and resolving complex issues; ability to prioritize tasks; and judgment in determining appropriate actions.

Competence in conducting hearings, preparing opinions and briefs, preparing cases for trial, conducting research, summarizing findings, interpreting and applying laws, utilizing legal reference materials, communicating effectively, and providing guidance to others.
