Overview

Disability Rights Texas is seeking a highly skilled and experienced Residential Child Care Monitor and Investigation Attorney to join our team. As a Residential Child Care Monitor, you will conduct onsite monitoring of residential care facilities to ensure compliance with specific guidelines and protocols. As an Investigation Attorney, you will investigate and identify abuse, neglect, and rights violations, providing legal services and determining eligibility for Disability Rights Texas client services.

Responsibilities

  • Conduct onsite monitoring visits of residential care facilities to evaluate compliance with licensing requirements, rules, regulations, and policies and procedures.
  • Investigate and identify abuse, neglect, and rights violations, providing legal services and determining eligibility for Disability Rights Texas client services.
  • Provide legal assistance, direction, and supervision to Advocates, when appropriate.
  • Implement agency's client services policies and procedures regarding client interviews, case records, investigations, case advocacy, and case files.
  • Develop and/or maintain ongoing caseload within the level established by the agency's client services policies and procedures and meets expectations for litigation.
  • Strong and effective writing, verbal, and negotiating communications skills, including the ability to do so in a concise manner, even when doing so regarding complex issues to a variety of people.
  • Demonstrated effective written and oral communication skills, including the articulation of well-thought-out arguments, drafting complaints, briefs, memorandums of law, and other pleadings, conducting depositions and other discovery methods, engaging in negotiations and settlement discussions, writing demand letters, and other correspondence.
  • Demonstrated knowledge of complex state and federal rights protection statutes, laws, and regulations.
  • Excellent interpersonal, relationship-building, and collaboration skills to be able to work effectively with others inside and outside of the organization.
  • The ability to take direction and independently follow through on all instructions.
  • The ability to research, analyze, and disseminate relevant issues and apply information effectively.
  • Willingness and ability to travel three to four consecutive days monthly, even to remote rural locations.
  • Excellent detail-orientation, follow-up skills, and organizational skills, plus the ability to multi-task and work under challenging conditions while meeting deadlines.
  • Demonstrated functional knowledge of complex laws, regulations, and programs on both the state and federal level affecting persons with disabilities or foster youth.
  • Ability to work well with others in a team environment, but also the ability to work independently and exercise independent professional judgment.
  • Knowledge and skills to appropriately monitor residential child care facilities.
  • Ability to multitask, prioritize conflicting assignments, and work under challenging conditions while meeting required deadlines.
  • Excellent interpersonal, relationship-building, and collaboration skills to be able to work effectively with others inside and outside of the organization.
  • Excellent detail-orientation, follow-up skills, and organizational skills.
  • Strong computer literacy, including knowledge of Microsoft Office suite (Outlook, Word, Excel, PowerPoint).
  • Knowledge of the state and federal laws and regulations relating to Residential Child Care Facilities.
  • Demonstrated knowledge of intellectual disability, emotional disturbance, physical disabilities, developmental disabilities, and trauma-informed treatment as applied to children.
  • Demonstrated knowledge of interviewing techniques, especially of children.
  • Skill in assessing immediacy of harmful situations, which might result in the physical or psychological injury or death to a child.
  • Ability to evaluate investigation records in relation to the Texas Department Family and Protective Services standards for quality.
  • Ability to analyze reports and produce comprehensive documents regarding findings.
  • Skill in establishing and maintaining effective working relationships.
  • Skill in effective verbal and written communication.
  • Ability to maintain a high level of confidentiality.
  • Ability to manage hostility and resistance to regulation in a professional, non-defensive manner.
  • Ability to establish and maintain effective work relationships with team members and others.
  • Knowledge of investigative principles, techniques, and procedures.
  • Experience monitoring for compliance with policies and procedures.
  • The ability to independently analyze qualitative and quantitative program-specific data.
  • Flexibility in work hours required for this position. Requires some overnight travel and weekend work.
  • Perform other duties as requested or required.

Preferred Qualifications

  • Bilingual in English/Spanish – both in written and spoken communication.
  • Experience investigating or monitoring facilities for compliance with laws, rules, policies, and procedures.
