NY HELPS:

This position is part of the New York Hiring for Emergency Limited Placement Statewide Program (NY HELPS). During the NY HELPS Program, this role may be filled through a non-competitive appointment. No examination is necessary, but candidates must fulfill the non-competitive minimum qualifications. The Office of Temporary and Disability Assistance (OTDA) may recruit and hire personnel through temporary appointments. If a temporary NY HELPS employee demonstrates satisfactory performance, the appointment may transition to a permanent non-competitive status, initiating an official probationary period. Within a year of permanent appointment, employees hired under NY HELPS are expected to transition to competitive status without the need for examination. Once in a NY HELPS role, employees can participate in promotion examinations for which they qualify.

NON-COMPETITIVE QUALIFICATIONS:

  • Hearing Officer 1 (SG-25): 12 months as an Assistant Hearing Officer, or Admission to the NYS Bar and 24 months of subsequent legal experience.
  • Assistant Attorney 1: Graduation from law school and/or eligibility for NYS Bar Admission.
  • Assistant Attorney 2: Admission to the NYS Bar.
  • Assistant Hearing Officer: 12 months as an Assistant Attorney 2, or Admission to the NYS Bar and 12 months of legal experience.
COMPETITIVE QUALIFICATIONS:

Eligible for a lateral transfer or transfer under Section 52.6 of the Civil Service Law with one year of permanent competitive service.

Desired Competencies:

  • The Office of Administrative Hearings (OAH) seeks ideal candidates who are fair, impartial, and dedicated decision-makers. They encourage applicants, even if they do not meet all criteria. OAH aims to represent all segments of New York State's population, especially those in vulnerable situations.
  • Ideal candidates should be passionate, polite, patient, possess a strong academic background, and manage a fast-paced workload. It is advantageous to be energetic, creative, well-organized, independent, diligent, personable, with strong oral advocacy and writing skills. Experience in social service benefit programs is a plus. Hearing Officers at OAH produce decisions following hearings and undergo a comprehensive training program.
  • Successful candidates should research OTDA and OAH prior to applying. Reviewing relevant laws and orders is recommended.

Duties Description: Hearing Officers will function as Administrative Law Judges presiding over impartial hearings for social services benefit programs. Responsibilities encompass conducting hearings, reviewing appeals, issuing subpoenas, safeguarding due process, maintaining impartiality, analyzing evidence, drafting decisions, and remaining informed about relevant laws and regulations.
