Position Overview

The Lead Trial Counsel will represent the United States in comprehensive "first chair" trial and appellate litigation.

At the trial phase, attorneys will independently manage their cases, conduct thorough fact investigations, collaborate with expert witnesses, and handle written discovery processes. Responsibilities include taking and defending depositions, drafting all substantive and procedural briefs, overseeing all trial aspects, and presenting oral arguments in the United States Court of International Trade.

Attorneys will also manage all appeal processes in the United States Court of Appeals for the Federal Circuit. Furthermore, they will engage in settlement discussions and recommend appropriate settlements when necessary. In their case management, attorneys will work closely with legal counsel from various Federal client agencies.

Matters within the purview of this position include, but are not limited to: challenges from importers regarding U.S. Customs and Border Protection decisions related to the classification and valuation of imported goods, legal disputes concerning the interpretation and application of trade-related presidential proclamations, executive orders, international treaties, and free trade agreements; conflicts over the government's denial or revocation of licenses under customs laws; and actions for the collection of duties and penalties under customs regulations.

Work Environment

The department offers a dynamic and collaborative work atmosphere that demands attorneys exercise sound judgment consistently. Candidates must possess exceptional time-management abilities and be prepared to take on significant responsibilities. Due to the nationwide jurisdiction of the court, travel may be necessary. This role is non-supervisory.

Employment Conditions

Applicants must be U.S. citizens or nationals and must complete a background investigation, including drug testing. Selective Service Registration is required where applicable. A fourteen-month trial period may be necessary, and candidates must be able to obtain and maintain a Top Secret security clearance with eligibility for Sensitive Compartmented Information (SCI) access based on organizational assignment or duty location.

Qualifications

Applicants must hold a J.D. or equivalent degree from an accredited law school and be a member in good standing of the bar in any U.S. jurisdiction. To qualify at the GS-13 level, candidates must have at least 1.5 years of post-J.D. experience; for GS-14, a minimum of 2.5 years; and for GS-15, at least 4 years of post-J.D. experience. U.S. citizenship is mandatory.

Successful candidates will demonstrate excellent writing and advocacy skills, alongside superior negotiation and interpersonal abilities. They should be highly motivated, exhibit sound judgment and creativity, and possess several years of active litigation experience.

Education Requirements

All academic qualifications must be obtained from a college or university accredited by a recognized accrediting body. Education completed in foreign institutions may also meet these requirements if equivalency can be demonstrated.

It is the applicant's responsibility to provide timely evidence of the credibility of foreign education through a credentialing agency with their application materials. All documentation must be in English or include an English translation.
