Position Overview

The role being offered is an Hourly/Wage position, where employees are limited to an average of 29 hours per week and a maximum of 1500 hours within the wage employment year. This position does not encompass health insurance, retirement, or paid leave benefits.

Key Responsibilities

The selected candidate will serve as a Legal Representative for the Commonwealth of Virginia, primarily focusing on employee grievance proceedings under the established State Grievance Procedure. The responsibilities include:

  • Formulating a comprehensive case strategy that effectively demonstrates compliance with agency policies.
  • Engaging in pre-hearing conferences and making necessary pre-hearing motions.
  • Drafting pre-hearing and post-hearing briefs as required.
  • Coordinating with local Human Resources to arrange logistical details for hearings.
  • Preparing and notifying witnesses regarding hearing schedules.
  • Assembling and submitting evidence binders and witness lists for hearings.
  • Presenting the agency's case during hearings, including making opening and closing statements and questioning witnesses.

Human Resources Coordination

The Advocate will also function as the primary coordinator for human resources records, ensuring the proper gathering, redaction, and response to requests for personnel records in accordance with the Grievance Procedure and relevant laws.

Qualifications

  • Proven ability to develop organized and persuasive case strategies.
  • Strong communication skills to interact effectively with all levels of employees.
  • Experience in applying legal principles to specific cases and providing recommendations.
  • Ability to negotiate with opposing parties in adversarial situations.
  • Knowledge of employment-related laws and regulations.
  • Capacity to work independently and manage time effectively.
  • Experience in conducting legal research and drafting legal documents.
