OATH also encompasses the Center for Creative Conflict Resolution, which offers mediation and restorative justice support to City government agencies and the public, along with the Administrative Judicial Institute, a resource center dedicated to training, continuing education, research, and support services for administrative law judges and hearing officers.

POSITION SUMMARY:

OATH is looking to appoint a Lead Special Education Hearing Officer to oversee the administration of special education impartial due process hearings for students with disabilities aged 3-21, in accordance with relevant regulations. The Lead Special Education Hearing Officer will collaborate with the Deputy Commissioner of the Division to supervise all adjudicatory activities related to the impartial hearing process for parents, guardians, or school districts seeking resolution under applicable federal laws.

The Individuals with Disabilities Education Act (IDEA) establishes due process procedures for resolving disagreements between parents and school districts regarding the identification, evaluation, educational placement, or provision of a free appropriate public education for students with disabilities. Such disputes may be addressed through an impartial hearing, where parties present and contest evidence before a hearing officer.

Key Responsibilities:

  • Oversee all pre- and post-hearing adjudicatory activities to ensure timely determinations regarding student services.
  • Monitor the progress and timelines of cases managed by Special Education Hearing Officers.
  • Ensure compliance with federal and state laws and regulations under the IDEA and related acts.
  • Assist in preparing and coordinating necessary notices and documentation to uphold due process rights for students with disabilities.
  • Serve as a continuous training and educational resource for Special Education Hearing Officers regarding updates in federal and state laws, regulations, and judicial decisions.
  • Develop public-facing analyses and reports for stakeholders, including elected officials and community members.
  • Conduct hearings via remote means and in-person, evaluating evidence and maintaining courtroom procedures.
  • Facilitate settlement discussions between parents and the New York City Department of Education.
  • Issue comprehensive written decisions.
  • Perform legal research concerning state and federal education laws, the IDEA, and special education programs.
  • Manage special assignments and projects, including oral and written presentations.
  • Maintain a high level of professionalism and effectiveness in handling assigned matters promptly.

Qualifications:

Admission to the New York State Bar is required, along with four years of recent, full-time, relevant legal experience following bar admission, including at least eighteen months in a supervisory role over other attorneys in an administrative, managerial, or executive capacity, or performing highly complex legal work.

Incumbents must remain members of the New York State Bar in good standing throughout their employment.
