Position Summary

The Litigation Staff Attorney or Senior Litigation Attorney will work with the Legal Director, fellow attorneys on the Legal Team, the Council’s Policy Team, Paralegals, and Legal Assistants to pursue litigation, and legal advocacy on a broad spectrum of issues, which may include the right to counsel, asylum laws, issues around the immigration courts, and border enforcement.


As with all positions at the Council, this position requires commitment to the Council’s mission and the organization’s culture of philanthropy.


Essential Job Functions

Pursues impact litigation in Federal Court, including:

Files lawsuits

Drafts briefs, pleadings, and motions

Conducts discovery

Argues motions and appeals

Participates in developing the Council’s litigation strategy and generates new litigation.

Writes and submits amicus briefs to federal courts and agencies.

Provides legal advice and legal research to other departments at the Council, including the Council’s policy and communications departments.

Drafts practice advisories and other litigation resources for immigration practitioners.

Provides training and practice assistance to immigration practitioners.

Fosters collaboration with AILA, law firms, and other partner organizations.

Participates in working groups and coalitions in furtherance of the Council’s goals.

Serves as a spokesperson for the Council on selected issues.

Organizes and participates in litigation meetings.

Writes and edits blog posts, Council publications, website text, and other non-legal documents.

Supervises interns, fellows, and attorneys, as needed (senior litigation attorney position only)

Performs other related duties and tasks as assigned by the Legal Director or Deputy Legal Director.

Some travel is expected for this position, typically 4-8 times a year. This includes travel to (1) hearings and other litigation-related obligations, (2) Council trainings, (3) board meetings, and (4) conferences, approximately.

Requirements:

J.D. Degree required.

Admission to any State Bar.


Qualifications Include:

A strong understanding and commitment to the Council’s mission and values.

Legal experience:

For the litigation staff attorney position: At least 3 (three) years of legal experience, in either federal litigation or immigration law.

For the senior litigation attorney position: at least 10 (ten) years of legal experience, of which at least 5 (five) years should be in federal court litigation. Litigation experience should include experience in drafting pleadings, motions, and briefs; conducting discovery; and oral advocacy.

Experience working collegially in a team setting and across organizations.

Experience speaking at conferences and convenings.

Ability to think creatively about solutions to legal problems.

Strong communication skills, both written and oral.

Strong analytical skills.

Knowledge

Knowledge of immigration law and policy related to immigration enforcement and removal, as well as the immigration court system.

Litigation experience:

For the litigation staff attorney position: Federal court litigation experience and class action litigation experience preferred.

For the senior litigation attorney position: at least 5 (five) years of federal court experience required, with class action litigation experience preferred.

Spanish proficiency preferred.

Exposure to non-profit and government settings a plus.

Working knowledge and proficiency in Microsoft Office Suite (specifically Word, Excel, Outlook, and PowerPoint).

Demonstrated ability in providing creative and innovative solutions to current immigration issues.

Ability to accurately and concisely summarize complex information for policymakers, the press, and the general public.
