General Job Information
Job Summary
This position is with the District of Columbia Public Employee Relations Board (PERB). PERB is an impartial, quasi-judicial, independent agency that resolves labor management disputes between agencies of the District government and labor organizations representing agency employees. The five-member Board was created pursuant to Section 501 of the District of Columbia Comprehensive Merit Personnel Act (CMPA).
The Executive Director is responsible for overseeing the daily operations of the Board, supervising attorneys and a support staff in the headquarters office along with contracted hearing examiners. Incumbent manages an annual budget of over a million dollars. Incumbent provides PERB with invaluable insight and guidance for delivering its programs, policies and initiatives.
Duties and Responsibilities
Incumbent serves as the principal administrative officer of PERB and performs such duties as designated or assigned, including the investigation of all petitions, requests, complaints, and other matters referred or submitted to PERB.
Incumbent is responsible for and oversees the daily operations of PERB and provides leadership and direction to subordinate staff. Incumbent facilitates the Board in determining appropriate compensation and non-compensation bargaining units; certifies and decertifies labor organizations as exclusive bargaining representatives; adjudicates unfair labor practice complaints; considers appeals of grievance arbitration awards; investigates standards of conduct complaints; determines whether a particular subject or proposal is within the scope of bargaining; facilitates the resolution of impasses in contract negotiations; and adopts rules and regulations for conducting the business of the Board.
Incumbent, consistent with the above-noted responsibilities, may issue subpoenas, conduct hearings, and retain independent counsel to represent its interests.
Incumbent resolves bargaining impasses through fact-finding, final and binding arbitration, or other methods agreed upon by the parties as approved by the Board and remands disputes if it believes further negotiations are desirable. Arbitration shall not be conducted by the Board itself, but the Board shall provide arbitrators selected at random from a panel or list of arbitrators maintained by the Board and consisting of persons agreed upon by labor and management.
Decide on disputed cases as to whether a matter is within the scope of collective bargaining. Develop a system for the collection, maintenance, and dissemination of labor management relations information as appropriate to the needs of the District, labor organizations and the public. Recommend desirable revisions or amendments to the District government labor relations law and PERBs rules and regulations for conducting its business and carrying out its powers and duties.
Decides and takes appropriate action on charges of failure to adopt, subscribe, or comply with the internal or national labor organization standards of conduct for labor organizations. Confers with, and incorporates the concerns of board members, District Government officials, members of administrative bodies, and officials outside the District Government regarding labor laws. Serves as spokesperson for the agency in presenting, explaining, and advising on PERB policy findings to policy makers. Reviews Board directives and correspondence, including standard operating procedures, reporting requirements, and other legal documents related to unfair labor practices. Performs other related duties as assigned.
Qualifications/Education
Must possess a Juris Doctor from a law school accredited by the American Bar Association (ABA) at the time of appointment.
Specialized experience is experience which is directly related to the position and has equipped the individual with the knowledge, skills, and abilities to successfully perform the duties of the position. To be creditable, the incumbent must possess at least one (1) year of specialized experience equivalent to the next lower grade level in the normal line of progression.

Work is performed in a typical office environment.
Licenses and Certifications
Must be an active member in good standing of the District of Columbia Bar or have the ability to waive in and be admitted within 360 days of appointment. An appointee to the Legal Service position shall remain a member in good standing of the District of Columbia Bar during his/her employment in the Legal Service. (If eligible for waiver, incumbent must successfully obtain admission to the bar within twelve (12) months of appointment).

Position Designation: This position has been designated as security sensitive therefore the incumbent of this position will be subject to enhanced suitability screening pursuant to Chapter 4 of DC Personnel Regulations, Suitability and as such, incumbents of this position shall be subject to criminal background checks, and background investigations, as applicable.
Residency Requirement: If the position you are applying for is in the Career, Management Supervisory, or Educational Service at an annual salary of one hundred fifty thousand dollars ($150,000) or more, you must establish residency in the District of Columbia within one hundred eighty (180) days of the effective date of the appointment and continue to maintain residency within the District of Columbia throughout the duration of the appointment.
