Job Title: Commercial and Contract Manager

Capgemini Government Solutions is seeking a highly skilled Commercial and Contract Manager to join our team. As a key member of our Client Account Team, you will play a crucial role in ensuring the successful delivery of our government clients' projects.

Key Responsibilities:
  • Deal Shaping and Commercial Strategy: Develop and implement commercial strategies to enhance the competitiveness and profitability of sales initiatives.
  • Contract Finalization and Start-up: Lead the finalization of contracts, ensuring all terms and conditions are clear and agreed upon, and facilitate a seamless transition from contract finalization to the start-up phase.
  • Client Management: Establish strong client relationships, participate in client governance, and provide regular updates on contract reviews and other matters.
  • Documentation and Communication Management: Manage contractual communications, collect and store evidence for dispute management, and track information shared with clients.
  • Contract Awareness: Coordinate and put in place Capgemini internal contractual agreements, provide contract training to the engagement team, and maintain awareness levels of engagement team members on the scope and limitations of our termination support and/or any re-procurement support obligations.
  • Contract Set-up and Governance: Serve as the primary point of contact for all commercial and contract matters arising on the account/engagement, providing support and guidance to the account team and interacting with the client as required.
  • Obligation and Compliance Management: Track obligations and help engagement team members understand Capgemini and client obligations, work with Legal to understand Legal obligations on how compliance with laws and regulations should be implemented in our accounts, and maintain up-to-date compliance with laws, regulations, and policies.
  • Margin/Revenue/Booking Protection and Improvement: Work with the engagement team to identify and implement opportunities to reduce cost and/or improve margin, manage and mitigate risks, and record commercial risks on the engagement RAIDE/Risk log.
  • Intellectual Property Rights: Collaborate with Procurement and, if needed, Legal, to produce a briefing on Capgemini's, third parties', and the client's rights and obligations in respect of IP, highlighting any non-standard provisions and/or other material topics that the team should be aware of.
  • Change Management: Identify where contract change notices are needed, draft amendments to contracts, review work orders and change orders, set up processes to review and expedite signature on WO, track, and minimize work at risk.
  • Dispute Management: Proactively anticipate and manage business-as-usual commercial/contractual queries and disagreements in anticipation of avoiding them escalating into formal disputes, identify, collate, and provide key documents relevant to disputes and potential disputes, work with Legal, the engagement team, and the wider business to manage the dispute resolution process in accordance with the contract, and work closely with Legal and other stakeholders to understand the risk and exposure facing Capgemini and jointly agree a strategy for handling.
Requirements:
  • U.S. Citizenship is required.
  • Eligible to obtain and maintain Government Security Clearance.
  • Bachelor's degree in Business, Law, or a related field.
  • 10 years of proven experience in commercial and contract management.
  • Certification in Contract Management (e.g., CCM) is a plus.
