Job Overview:

The Employment Counsel at CJ America, Inc. will be responsible for overseeing all legal aspects related to general employment law, encompassing both the U.S. headquarters and certain U.S. affiliates in various industries. This role will report directly to and collaborate closely with the General Counsel.

Key Responsibilities:

  • Provide expert guidance on employment and labor law matters, ensuring compliance with federal, state, and local regulations, including the Fair Labor Standards Act (FLSA), California Labor Code, Title VII of the Civil Rights Act, Americans with Disabilities Act (ADA), and other relevant laws.
  • Offer strategic legal advice on general employment law matters, human resources conduct, workplace policies, performance management, compensation and benefits, human resources issues, internal investigations, worker classification, accommodations, terminations, leaves of absence, recruiting, and hiring.
  • Proactively identify and assess legal risks, advising management and HR teams on compliance requirements and potential liabilities related to employment matters, including discrimination, harassment, retaliation, wage and hour laws, and employee benefits.
  • Collaborate with HR on compliance risk assessments and develop strategies to mitigate risks and ensure organizational compliance.
  • Negotiate, review, and draft employment/HR-related agreements, including executive employment agreements, non-compete agreements, confidentiality agreements, and severance agreements.
  • Ensure the organization's policies and practices comply with all relevant laws and regulations by reviewing and updating employee handbooks, policies, procedures, SOPs, and guidelines related to employment and compensation matters.
  • Stay up-to-date on employment law developments at the federal, state, and local levels, particularly in California, and communicate effectively with internal stakeholders on updates and best practices.
  • Advise on employee relations matters, including disciplinary actions, grievances, and investigations into complaints of harassment, discrimination, or other misconduct.
  • Manage potential or active litigation matters related to employment, including Title VII and FEHA, leaves of absence, wrongful termination, reductions in force, harassment, and wages and hour matters.
  • Manage outside counsel/law firms handling certain employment matters and litigations, ensuring cost-effectiveness and optimal results.
  • Provide guidance and support to foreign national employees on visa applications, status maintenance, travel restrictions, and other immigration-related matters.
  • Monitor changes in immigration laws, regulations, and policies to ensure ongoing compliance with visa requirements and eligibility criteria.
  • Develop strategies to mitigate risks, streamline visa processes, and optimize the organization's ability to attract and retain international talent.
  • Uphold the highest ethical standards in the practice of law and ensure compliance with professional rules of conduct and maintain confidentiality and protect sensitive information related to employee matters and legal affairs.

Requirements:

  • JD from an accredited law school
  • 5-8 years of experience in employment law in California
  • Must be admitted and in active status with the California State Bar (or permitted to work as in-house counsel under the rules of your state of residence)
  • In-house experience in California
  • Bilingual in English/Korean preferred

Supervisory Responsibility:

This position does not have direct supervisory responsibilities.

The anticipated base salary range for candidates working in Los Angeles, CA is $120K to $150K. The final salary offered will be subject to several factors, including experience, industry, educational background, and location. This salary range may not reflect the pay scale for employees working in other states.
