Overview:

Required Qualifications:

Education/Certification:

  • Juris Doctor degree from an ABA accredited law institution
  • Valid license to practice law in Texas, maintaining good standing

Essential Knowledge and Skills:

  • Familiarity with local, state, and federal laws and regulations pertinent to public education
  • In-depth understanding of school personnel law
  • Proven skills in legal research and litigation
  • Comprehensive knowledge of the legislative process
  • Ability to interpret legal documents, policies, and procedures
  • Effective communication skills, both written and verbal, across all management levels
  • Strong public relations, organizational, communication, and interpersonal abilities

Experience:

A minimum of three years in public or private legal practice addressing issues related to local, state, federal government, or public education law.

Key Responsibilities:

Legal Representation:

  1. Provide legal advice to the superintendent, staff, and board on various matters, including personnel and student issues, as well as compliance with public information regulations.
  2. Draft, review, and amend legal documents as necessary.
  3. Participate in board meetings and other administrative gatherings to offer legal guidance.
  4. Assist in coordinating legal services from external law firms, including managing contracts and reviewing invoices.
  5. Act as the district's hearing officer for relevant student and employee grievances, complaints, and appeals as per policy.
  6. Serve as the district's compliance officer for applicable state and federal laws.
  7. Provide guidance regarding district records, including requests under public information laws.

Legal Oversight:

  1. Ensure adherence to policies set forth by federal and state laws, State Board of Education regulations, and local board policies while serving as the district's compliance officer.
  2. Monitor and assess the implications of proposed or enacted legislation.
  3. Coordinate responses to inquiries from the Texas Education Agency, U.S. Department of Education Office for Civil Rights, and other regulatory bodies.
  4. Ensure compliance with the Texas Open Meetings Act and procurement requirements.
  5. Provide legal support for district elections.

Policy Development and Reporting:

  1. Assist in developing and implementing policies and regulations, and review materials for inclusion in handbooks.
  2. Compile, maintain, and present all necessary reports, records, and documents.
  3. Adhere to district safety protocols and emergency procedures.

Training and Communication:

  1. Conduct professional development sessions and training, including preparing materials for staff and board members.

Additional Duties:

Perform any other responsibilities assigned by the immediate supervisor.

Supervisory Responsibilities:

Oversee and evaluate the performance of assigned support staff.

Working Conditions:

Tools/Equipment Used: Standard office equipment, including computers and peripherals.

Posture: Prolonged periods of sitting, with occasional bending, stooping, pushing, pulling, and twisting.

Motion: Repetitive hand movements, including frequent typing and mouse usage, with occasional reaching.

Lifting: Occasional light lifting and carrying (up to 15 pounds).

Environment: Frequent extended or irregular hours, with travel required.

Mental Demands: Ability to work with frequent interruptions while maintaining emotional control under stress.
