Qualifications:

Education/Certification:

  • Juris Doctor degree from an ABA accredited law institution
  • Active legal license in the State of Texas, maintaining good standing

Essential Knowledge/Skills:

  • Familiarity with local, state, and federal legislation relevant to public education
  • Expertise in educational personnel law
  • Proven legal research and litigation capabilities
  • In-depth understanding of the legislative framework
  • Ability to interpret legal documents, policies, and procedures
  • Effective communication skills, both written and verbal, across all management levels
  • Strong public relations, organizational, and interpersonal skills

Experience:

A minimum of three years in public or private legal practice addressing issues related to local, state, or federal government, or public education law.

Key Responsibilities:

Legal Representation:

  1. Provide legal counsel to the superintendent, staff, and board on various legal issues, including personnel and student matters, ensuring compliance with applicable laws.
  2. Draft, review, and amend legal documents as necessary.
  3. Participate in board meetings and other administrative gatherings to offer legal guidance.
  4. Coordinate with external law firms for legal services, overseeing contracts and reviewing invoices.
  5. Act as the district's hearing officer for relevant student and employee grievances, complaints, and appeals as dictated by policy.
  6. Serve as the district's compliance officer for applicable laws.
  7. Assist with district records management, including responding to requests under the Texas Public Information Act.

Legal Oversight:

  1. Ensure adherence to policies set forth by federal and state law, State Board of Education regulations, and local board policies while acting as the district's compliance officer.
  2. Monitor and analyze the implications of proposed or enacted legislation.
  3. Facilitate responses to inquiries from the Texas Education Agency, U.S. Department of Education Office for Civil Rights, and other regulatory bodies.
  4. Ensure compliance with the Texas Open Meeting Act and procurement requirements.
  5. Provide legal support for district elections.

Policy Development and Reporting:

  1. Assist in developing and implementing policies and regulations, and review materials for inclusion in handbooks.
  2. Compile, maintain, and present necessary reports, records, and documentation.
  3. Adhere to district safety protocols and emergency procedures.

Training and Communication:

  1. Conduct professional development sessions and training, including preparing educational materials for staff and board members.

Additional Duties:

Perform any other responsibilities assigned by the immediate supervisor.

Supervisory Responsibilities:

Oversee and evaluate the performance of assigned support staff.

Working Conditions:

Tools/Equipment Used: Standard office equipment, including personal computers and peripherals.

Posture: Prolonged periods of sitting, with occasional bending, stooping, pushing, pulling, and twisting.

Motion: Repetitive hand movements, including frequent keyboarding and mouse usage, with occasional reaching.
