Job Summary:
The University of Pennsylvania seeks a highly skilled and experienced Senior Counselor for Medical Malpractice and Risk Management to join its President's Center. As a key member of the University's legal team, this individual will be responsible for managing all medical malpractice claims involving the Health System and its insureds, providing legal support to Risk Management, and advising Health System physicians and staff on risk management-related issues.
Key Responsibilities:
- Manage Medical Malpractice Claims: Collaborate with Senior Counsel in the management of all medical malpractice claims involving the Health System and its insureds, including reviewing pleadings and discovery responses, overseeing document production, selecting experts, and conducting case analysis.
- Provide Legal Support to Risk Management: Offer legal guidance and support to Risk Management in identifying and mitigating potential risks, developing risk management strategies, and implementing policies and procedures to minimize liability.
- Advise Health System Physicians and Staff: Provide expert legal advice to Health System physicians and staff on risk management-related issues, including medical-legal implications, professional board inquiries, and litigation-related matters.
- Collaborate with Senior Counsel: Work closely with Senior Counsel in the oversight and evaluation of outside defense counsel in medical malpractice and other Health System-related litigation, including ensuring compliance with litigation guidelines and participating in internal case review meetings and Health System claims and risk-related committees.
- Undertake Direct Defense of Litigation: Occasionally, undertake the direct defense of medical malpractice and other Health System-related litigation from pleadings through settlement or trial.
- Participate in Risk Management Committees: Participate in Health System claims and risk-related committees to identify and mitigate potential risks, develop risk management strategies, and implement policies and procedures to minimize liability.
- Provide General Legal Advice: Offer general legal advice to senior management, staff, and employees of the Health System to protect the Health System from legal exposure and to maximize compliance with statutory, regulatory, and case law requirements.
- Develop Educational Programs: Develop and deliver educational programs on risk management-related issues, including medical-legal implications, professional board inquiries, and litigation-related matters, to Health System physicians, staff, and other stakeholders.
- Perform Other Related Duties: Perform other related duties as assigned by the President's Center or other University departments.
Requirements:
- JD from ABA Accredited Law School: Must have a Juris Doctor degree from an American Bar Association (ABA) accredited law school.
- Minimum 10 Years of Litigation Experience: Must have a minimum of 10 years of litigation experience, with an emphasis on medical malpractice litigation.
- Admission to Pennsylvania Bar: Must be admitted and in good standing in the Pennsylvania Bar or another state bar.
- Strong Critical Thinking and Strategic Skills: Must possess strong critical thinking and strategic skills, with the ability to analyze complex legal issues and develop effective solutions.
- Excellent Communication and Interpersonal Skills: Must have excellent communication and interpersonal skills, with the ability to work effectively with senior management, staff, and other stakeholders.
