Job Summary

The Texas Workforce Commission is seeking a highly skilled and experienced Attorney to join our team in the Division of Fraud Deterrence and Compliance Monitoring. As a key member of our team, you will be responsible for performing complex legal work, including examining and preparing legal documents, interpreting laws and regulations, and rendering legal advice and counsel.

Key Responsibilities

  • Assign and supervise the daily activities of the Fraud Prosecutions Unit (FPU)
  • Coordinate the preparation of Unemployment Insurance fraud cases for implementation of collection procedures and criminal prosecution, if necessary
  • Draft and edit case referral summaries for the Division of Fraud Deterrence and Compliance Monitoring (FDCM) Benefit Payment Control's benefit fraud cases and Office of Investigations' cases
  • Respond to District Attorney's offices questions regarding Prosecution cases
  • Foster working relationships with District Attorney's offices, federal regulatory and law enforcement entities, and probation departments to discuss cases, furnish records, and receive restitution payments
  • Review and edit subpoenas for accuracy and appropriate scope
  • Provide or prepare staff for grand jury testimony and trial, including preparing witnesses and furnishing evidence with business records affidavits
  • Provide the Deputy Director with status updates regarding indictments, dispositions, and future court dates, and updates monthly and quarterly FPU related measures
  • Evaluate current criminal law statutes and proposed legislation for their impacts on TWC related statutes and regulations

Requirements

  • Graduation from an accredited law school approved by the American Bar Association and admission to the State Bar of Texas
  • Two years of experience in the full-time practice of law, or two years of full-time experience in a responsible position involving legal work as a primary duty, or two years of full-time experience involving the legal aspects of administration in the fields of industrial or labor relations
  • Experience with criminal litigation, including the prosecution or defense of criminal matters
  • Experience working with District Attorney's offices, the Texas Office of Attorney General, and local law enforcement agencies
  • Experience with the Texas Penal Code and the Texas Code of Criminal Procedure
  • Experience with the Texas Unemployment Compensation Act
  • Experience with administrative hearings and other dispute resolution processes
  • Excellent legal research and writing skills
