In this role you will be responsible for the following:

Contested Foreclosure/Title Resolution:

  • Manage a portfolio of contested cases within the foreclosure litigation inventory as assigned
  • Appear in-person and telephonically as a records custodian and "fact" witness at jury and non-jury trials, depositions, etc. to explain servicing processes under oath as needed. Travel for appearance in person for trials that do not allow the witness to appear telephonically will be required
  • Ability to read, review, and interpret mortgage loan documents for the purpose of appearing as a corporate witness on contested litigated foreclosure matters
  • Settle cases with minimal supervision within given settlement authority parameters
  • Process all requests by assigned attorneys (by e-mail or telephone) for settlement authority, check requests, etc. to bring a suit to resolution
  • Coordinate efforts directly with the firms for efficient and effective responses to all requests for discovery to include admissions, interrogatories, and production of documents
  • Provide information support to the attorney network for legal recovery efforts
  • Identify and escalate to Supervisor and Manager any issues that cause liability or are above authority level
  • Identify and escalate to Supervisor and Manager any trends that could become problematic in future suits
  • Receive and process all correspondence received on accounts placed with assigned attorneys
  • Ensure that all actions, discovery, and witness requirements and obligations are tracked accordingly for future reference, if needed
  • Performs additional projects and duties as assigned by Management
  • Identify, research and resolve title issues that may prevent or otherwise cause delay of FC sale completion or post-sale conveyance.
Loan Administration Support:
  • Assist with the routine foreclosure process for all Judicial and Non-Judicial filing for all partner states as needed
  • File, organize and keep updated with attorney requests
  • Perform final review and execution of all documents (AOM, Affidavits, SOT, etc..) required in the foreclosure process
  • Track and handle outstanding attorney bills and invoices
  • Provide support and assist with other tasks as requested by Foreclosure staff such as, but not limited to; answering borrower foreclosure questions, prioritizing documents and data on a daily basis
Personal Development:
  • Participate in training and in cross-training on an individual basis and with department staff
  • Team player - willing to assist others (when needed)
  • Attend job-related classes and seminars to acquire necessary job-related knowledge
May perform other additional duties and responsibilities as assigned.

Requirements

Position qualifications required are the following:
  • High school diploma or equivalent, required
  • Bachelor's degree preferred
  • 5+ years direct foreclosure or mortgage servicing related experience required
  • Experience in the legal field with law firm desired
  • 3+ years in litigation resolution experience preferred
  • Must have strong communication skills; strong analytical skills; and strong organizational skills with attention to detail
  • Must meet individual and team case management goals
  • Must be effective in multi-tasking and be goal oriented
  • Must be able to work on a team or independently with minimal supervision
  • Must have a valid driver's license
  • Ability to travel up to 25% of the time
  • Excellent communication skills, both verbal and written
  • Ability to work independently and manage time effectively
  • Ability to take direction from other Foreclosure Teammates to provide accurate testimony
  • Ability to work effectively remotely and while traveling
