**Duties**:
**Performs assignments that involve providing leadership to others and providing authoritative legal expertise. Develops critical agency positions and provides guidance on critical legal issues to senior agency officials. Applies considerable experience and advanced, legal knowledge in enforcement-related appellate litigation assignments. Is considered a technical authority in at least one specialty area and performs most work independently.**

**Conducts thorough research and discovery, and prepares motions, pre-hearing memoranda of law, and post-hearing briefs in enforcement proceedings. Prepares and submits effective appellate, reply, and court briefs when assigned. Assists the Department of Justice with FAA aviation litigation actions adjudicated in U.S. District Court. Produces writings that are well-organized, clear, and persuasive. Effectively critiques own work product.**

**Provides legal advice and counsel to FAA management in appellate matters. Reviews and analyzes a variety of issues within the practice area to ensure compliance with existing laws, statutes, regulations, and agency policies.**

Provides appropriate advice tailored to the client and requirements of the agency. Effectively presents advice and adjusts communications to meet audience expectations and level of understanding. Consistently puts forth effort needed to accomplish tasks and produce work that is timely and of professional quality.

Demonstrates interpersonal skills needed to develop and maintain strong client relationships. Actively participates with clients to identify and meet client goals and objectives. Seeks consensus with client as to the timing and scope of work. Proactively identifies and appropriately pursues solutions to effectively represent the agency’s interests in responding to high-priority issues. Puts forth effort to meet established proficiency level goals and objectives. Keeps clients informed of developments, including why and when an extension may be necessary.

Develops and demonstrates knowledge and understanding of key client business processes, priorities, and objectives relevant to the practice area. Accurately identifies client business objectives and issues when providing legal advice. Provides appropriate alternative solutions as needed to meet client’s strategic business objectives. Provides legal risk/reward analysis in support of business decisions.

Demonstrates knowledge and understanding of when and the willingness to go to more senior-level clients based on risk levels. Demonstrates skill in representing the agency. Consistently puts forth effort needed to accomplish tasks and produce work that is timely and of professional quality.

Ensures laws, regulations, and policies provide general guidance for completing assignments. Considerable discretion is often required to develop new or innovative approaches or interpretations. Contacts are internal and external to the agency. Contacts vary with the purpose of contacts, the level of authority required to resolve issues, and the nature of the legal problem at hand. Typical contacts involve dealings with members of senior management, officials of various courts, representatives of professional organizations, representatives of industry groups, and representatives of other government agencies.

Keeps AGC management informed of client issues and activities that should be discussed at a higher management level.

Performs other duties as assigned.

- This Level 5 (Moderate Risk; Public Trust) position requires favorable adjudication of a Minimum Background Investigation (MBI) background investigation prior to appointment unless a waiver is obtained.

**Qualifications**:
To qualify for this position, **ALL applicants MUST meet the following criteria**:
(1) have a JD Degree from an accredited law school; and

(2) be admitted to practice before the bar of any U.S. jurisdiction state, territory, the District of Columbia or the Commonwealth of Puerto Rico; and

(3) be an active member of the BAR; and

To be considered for an **I Band**: Applicants must demonstrate at least one year (52 weeks) of SPECIALIZED EXPERIENCE equivalent to the next lower grade/pay band** (FG/GS-12 or FV-H)** that is typically related to the line of work of the position to be filled and which has equipped the applicant with the particular knowledge, skills, and abilities required to successfully perform the duties of the position. To be creditable, specialized experience must have been at least equivalent to the next lower level in the normal line of progression for the occupation in the organization.
