Job Status: Full-time; Salary - Exempt

Department:  Program

Location:  Albuquerque

Reports To:  Chief Executive Officer

Number of People Supervised: 1-3



POSITION PURPOSE

The purpose of this Pooled Trust Program Director is to provide for the collective management and distribution of the Trust Assets on behalf of eligible beneficiaries who are disabled. Primary functions of this position are to oversee the Master Trust(s) held by The Arc New Mexico on behalf of clients and/or beneficiaries: including discretionary authority; assisting clients with financial support to safeguard the individual’s assets to maintain their benefits to improve their quality of life, while conforming to all regulations, policies, and compliance functions required by law. The Pooled Trust Program Director shall lead the outreach and education to the community and organizations on the needs of individuals with disabilities. The goal is to assist the client and/or beneficiary and family to feel confident with the financial security of their trust.

 

Performance Measures:  A successful Pooled Trust Program Director will produce positive outcomes in the following areas:  maintain objectivity while exercising discretionary authority; ensure money spent will enhance the life of the client/beneficiary; stay up-to-date on all federal, state, and local laws regarding SSI, Medicaid, Investment and Property trust management; able to lead community outreach and education advocacy.





ESSENTIAL DUTIES AND RESPONSIBILITIES (IN PRIORITY ORDER)

Administration Duties:

  • Manage pooled trust fund distributions and maintains trusts files.

·      Maintain up-to-date knowledge of financial, estate, and income tax planning concepts.

·      Invest and manage trust property following the terms of the trust and state law, in the beneficiary’s best interests.

·      Meet compliance, account administration and customer service requirements of all Trust(s) in light of law, regulation, policies, and governing agreement.

·      Keep up with SSI and Medicaid income and resource rules so that the trustee’s spending doesn’t affect the beneficiary’s eligibility for SSI and Medicaid.

·      Respond to the beneficiary’s personal needs for goods and services that aren’t covered by SSI or Medicaid.

·      Maintain client/beneficiary, and other interested persons, contact and communication to ensure up-to-date information is provided regarding all trust activity, and needs are being met. This includes periodic reporting to clients.

·      Work closely with beneficiary’s representatives: Attorneys, court appointed guardian, or conservator, and service providers. Work closely with auditors and investment bankers as needed.

·      Maintain accurate records and required reports for SSI and Medicaid programs and manage the filing of all necessary federal and state tax returns.

·      Ensure accuracy of daily trust account processing and balance report, and balance asset accounts.

·      Knowledge of accounting and financial management principals and land trust transactions.

·      Knowledgeable of Trust software systems (TNet, TAMS, or other software systems as appropriate). Knowledge of accounting software (Excel)

·      Generate monthly investment activity and annual fees for all pooled trust fund accounts.

·      Knowledge of all public benefit programs.

·      Statewide training including marketing: including staff, beneficiaries, families, community agencies, and the public about Special Needs Trusts and trust services by The Arc.

·      Trust Committee team lead: bring a variety of atypical issues to committee for review, may escalate to legal review. Active member of the remainder fund committee.

·      Active member of Leadership Team. Review and participate in Agency problem solving, policy development or decision-making.

Supervisory Duties:

 

  • Oversee the Trust Administrative Coordinator: assign duties, provides training and support.

·  Assign temporary responsibilities to appropriate staff member when out of office to ensure continuity of trust oversight.

Other Duties as Assigned and that meet the minimum qualifications of this position.

 


EDUCATION& RELATED WORK EXPERIENCE

Education Level/ Years of Related Work Experience:

Minimum: Bachelor’s degree required with minimum of 3 years  trust operations experience. 

Preferred: Legal and financial experience.
