Our Organization and Mission: The Office represents the State of Florida in state and federal civil and criminal courts, from trial courts to the Supreme Court of the United States.

Pay: $75,000 Annually

Position Summary: This is an Assistant Attorney General position within the Office of the Attorney General Capital Collateral Unit. This position offers the unique opportunity to argue cases in the Florida Supreme Court and the Eleventh Circuit Court of Appeals. In addition, this position offers the opportunity to work with homicide prosecutors throughout the state in cases where the death penalty has been imposed.

Qualifications: Admission to the Florida Bar and two years of professional experience in the practice of law, legal research, teaching law or in administrative or judicial hearings.

The required legal experience must be from the practice of law in a state or territory of the United States.

Membership in good standing in another state Bar can substitute for the required admission to the Florida Bar provided that, pursuant to Rule of the Rules Regulating the Florida Bar, the attorney applies for and obtains admission to the Florida Bar within 12 months of appointment to a position in this class.

The Work You Will Do: This position's duties include but not limited to the following:

  • Serving as either lead counsel or co-counsel in the state circuit and Florida Supreme Court, as well as, representing the state in habeas actions in federal district, circuit, and United States Supreme Court. Litigation includes attendance at evidentiary hearings at all post-conviction and appellate stages, research, preparation of briefs, responses, motions, and other functions directly related to appeals (capital direct appeals, interlocutory actions, collateral appeals, and extra-ordinary writs).
  • Handles emergency circumstances (pleadings preparation and court appearances) in all levels of state and federal courts, including during the pendency of an active death warrant.
  • Responsibility also includes keeping current of all state and federal decisions directly or indirectly impacting on capital cases. This includes becoming familiar with all capital cases in the office and maintaining a communications network with other capital specialists in other offices.
  • Provides advice and assistance to other attorneys with legal analysis, brief preparation, and other attending responsibilities.

Other Requirements: An extensive comprehension of criminal law, constitutional law and federal habeas corpus practice is preferred.

Trial and/or appellate experience and an ability to handle time constraints; complex legal analysis and multifaceted litigation are minimal requirements.
