The Global Privacy Counsel will report to the Chief Privacy Officer and aid in enhancing Agilent's Global Data Protection and Privacy Program, under the umbrella of the Global Legal Compliance Program within the Legal Department. Candidates should be based in the US for this fully remote position but requires location alignment with the West Coast time zone, with a preference for West Coast or Mountain Time Zone.

The Global Privacy Counsel's day-to-day responsibilities will include:

The Global Privacy Counsel will excel at collaboration. They are expected to engage in active communication with the team, seek assistance when needed, extend support to others, and build robust connections with the wide range of stakeholders involved in supporting the Program.

The role involves tracking and detailing current and upcoming regulations related to data protection, privacy, cyber security, artificial intelligence, and data governance globally, evaluating how they might affect Agilent's worldwide operations. The chosen individual will use a risk-based approach to evaluate new legislations and outline essential compliance measures, ensuring that this information is conveyed effectively and practically to crucial parties like the Legal team, Human Resources, IT, and Business Executives.

Lead Data Protection and Privacy initiatives to fruition, this includes projects centered on compliance with newly established or updated legislation comprising data mapping, creating policies, and conducting training, as well as efforts related to enacting new policies and practices throughout Agilent. The ideal applicant is systematic and orderly in project management and skilled at coordinating with various stakeholders to ensure the successful execution of projects.

Actively collaborating with all Agilent functions on Data Protection, Privacy, and AI matters, this role entails working with the Chief Privacy Officer to establish risk-based strategies for various data protection, privacy, and AI issues. The ideal candidate is ready for the field's complexities but also open to admitting knowledge gaps and committed to promptly researching and resolving them.

Proactive communication with the team and other stakeholders is essential, as is articulate dissemination of crucial information and advice, including support for managing Agilent's Data Privacy Board and Functional Privacy Champions.

Proactively develop an understanding of company products, services and general organizational knowledge to assist in developing effective Data Protection, Privacy and AI compliance strategies, policies, procedure and guidance.

Provide counseling to Product & R&D teams regarding new product developments and company practices and tools that impact data protection and privacy.

Develop and communicate risk-based, clear, easy and actionable content for Agilent regarding Data Protection and Privacy-related practices and procedures. Create and deliver engaging training content and partnering with Legal and others as needed.

Support the negotiation of data processing agreements with any third party Agilent interacts with (customer, supplier, channel partner).

Draft and maintain clear and usable templates of data processing agreement templates, along with associated guidance documents such as negotiation. Actively support risks assessments of Agilent's Data Protection & Privacy program, including audits and external data protection officer reviews.

Respond to external requests regarding the program, including response to customer and other third-party questionnaires.

Advise and support Agilent's response to Data Subject Requests globally. Provide legal analysis and support to Agilent's Incident Response process globally.

Support the effective management of Outside Counsel and other Supplier relationships.

Providing other support as required to operate Agilent's Global Data Protection and Privacy Program, including assistance with regulatory registrations, maintaining, and updating compliance documentation and policies.

Supporting and providing guidance on the implementation of Agilent's Records and Information Management policies, including Agilent's General Retention Schedule.

Engaging as a positive and reliable member of the Global Legal Compliance team and supporting broader Compliance Program initiatives, including ESG, trainings, development and implementation of policies and systems, and other activities in support of the program.

Qualifications

  • Juris Doctor in Law.
  • License in good standing to practice law in a US state.
  • 4+ years relevant legal experience.
  • Experience with global data protection and privacy laws is a must, including GDPR, PIPL, CCPA.
  • Working knowledge of the emergence of AI regulations globally is required.
  • Excellent communication and influencing skills – comfort in public speaking is a must.
  • Strong negotiation skills with the capacity to influence outcomes.
  • The Global Privacy Counsel must have a strong sense of integrity and ability to work collaboratively and independently within a matrixed organization.
  • Given the global nature of the work, the successful candidate must demonstrate experience working with teams that span multiple regions, e.g. Asia, Europe and the Americas. It is important that the Global Privacy Counsel can drive strategic privacy initiatives and compliance results across regions, businesses and functions. A global perspective is essential.
  • Proficiency using information technology; experience in using OneTrust as a plus.
