JOB SUMMARY

The Compliance and Privacy Specialist is responsible for the implementation of all aspects of the patient privacy program including complaints, privacy investigations, correspondence, reporting and monitoring, along with assisting in the day to day activities of the compliance program. Works with Leadership and outside parties on the sharing of Protected Health Information by assisting in the execution of Business Associate Agreements. The Compliance and Privacy Specialist develops reports and conducts audits proactively. The position monitors policies and procedures and develops updates for system wide education to align with changes to compliance and privacy regulations. The Compliance and Privacy Specialist works collaboratively with Internal Audit, Risk Management, HIM and the IT Security Officer.

ESSENTIAL DUTIES AND RESPONSIBILITIES

· Assists in the development, implementation, and monitoring of key compliance and privacy functions and risk areas in accordance with guidance for compliance and HIPAA privacy programs.

· Completes all steps necessary to resolve privacy complaints and incidents. Reviews the complaint or incident information, investigates, addresses concerns, documents findings, and corresponds with the complainant and/or leadership.

· Works with leadership regarding privacy or compliance concerns, violations, and proposed sanctions of staff with Human Resources or Medical Staff leadership.

· Utilizing the privacy monitoring tool prepares reports, creates new reports, reviews report information to focus audits, investigates variances, documents findings, and communicates with the Compliance Officer.

· Utilizing the excluded individual’s compliance tool, runs month reports reviewing for sanctioned individuals.

· Assures that the Business Associate Agreement template is current. Reviews requests for transmission or access to Protected Health Information working with the internal customer requesting and the outside party, involving the Compliance Officer as needed. If approved, obtains appropriately executed agreement and updates files.

· Suggests continuous improvement and solutions for the privacy function. Identifies root causes of issues, assesses trends, recommends changes, and reports these to the Compliance Officer.

· Annually reviews the HIPAA privacy and compliance mandatory education modules working with the Center for Learning and Innovation and recommends enhancements and/or modifications if needed.

· Assists with policy drafting and updates by tracking developments in state and federal regulations and laws.

· Facilitates and promotes activities to foster information privacy awareness through development of creative communication strategies and messages to specific audiences.

· Proactively conducts department specific HIPAA training to ensure compliance with policies, procedures, and regulations.

· Works cooperatively with HIM staff in Release of Information, requested Amendments to the Medical Record or to restrict access to protected health information, when appropriate. Prepares Accounting of Disclosure reports for patients upon request.

· Performs rounding and audits to ensure compliance with policies, procedures, and regulations.

· Works collaboratively with the IT Security Officer to facilitate a strong privacy program.

· Maintains integrity of privacy breach files with all supporting documentation and systems. Responsible for ensuring mailings to breached individuals are accurate, timely and recorded for regulatory requirements and reporting.

EDUCATION, EXPERIENCE AND QUALIFICATIONS

· Minimum of a bachelor’s degree in Finance or health care related field.

· Minimum of 2 years’ experience in HIPAA privacy or healthcare compliance.

· Experience with the FairWarning© platform desirable.

· Accreditation by the American Health Information Management Association (AHIMA); Health Care Compliance Association (HCCA); Registered Health Information Technician or Administrator (RHIT/RHIA); or equivalent desirable.

· Proficient in the Microsoft Office Suite (Word, Excel, PowerPoint, Outlook).

· Strong understanding of Cerner or EPIC electronic medical record systems.

· Intermediate computer knowledge: Uses Microsoft Word, Excel, Outlook, and Windows
