GS-11:
Drafts decisions and orders for the Supervisory Attorney's review and ultimately the Board's consideration. With guidance from a higher-grade mentor or Supervisory Attorney, works on specific cases that involve difficult legal or factual questions. Reviews the case record, including the pleadings, testimony, medical evidence, and other exhibits, to determine the issues raised and the relevant facts; conducts legal research of relevant statutes, regulations, case-law, legislative history, and other legal authorities on the issues raised and analyzes their application to the case; after reviewing the parties' arguments in conjunction with the relevant legal authorities and facts of the case, determines the legal conclusion, and then prepares a draft decision or order setting forth the Board's holdings and reasoning to be presented to a higher-grade mentor and/or the Supervisory Attorney for further review before consideration by the Board.

Completes special projects as assigned by the supervisor, including developing, compiling, or revising internal Board procedure directives or writing and style standards.

Performs other duties as assigned.

GS-12
In addition to the GS-11 duties listed above, GS-12 major duties include the following:
May prepare a case analysis memorandum, providing a proposed disposition of the issues raised on appeal and a recommended disposition in the case. In this situation, presents recommended disposition to a panel of the Board, either through a written memorandum or oral presentation.



Participates in conferences in certain complex cases with the full Board and supervisory attorneys. Similarly, attends and provides support in oral arguments, where the parties appear before the Board in novel cases or where clarification is essential to the case disposition.



As directed, may assist Members in their preparation of a dissenting or concurring opinion.



When further consultation or justification is required, confers with and advises the Board Members on assigned cases that involve new law and establish new precedent. Such advice often requires extended discussions of the legal issues involved, presentation of facts out of which the legal issues arose, and examination of the effects of a particular proposed decision upon general interpretation of the Acts, in light of congressional intent.
