Definition and Distinguishing Characteristics

Part-Time Schedule: This role equates to 24 hours per week; all benefits will be pro-rated according to the final part-time schedule.

Under general supervision, the Child Custody Mediation Specialist facilitates the Court process by providing child custody mediation services aimed at resolving disputes related to contested custody and visitation matters. In cases where an agreement is not reached, the specialist will prepare written recommendations for the Court and involved parties regarding the best interests of the child/children concerning unresolved custody and visitation issues. This position operates under the provisions of the Trial Court Employment Protection and Governance Act.

This classification represents a journey-level professional role. Most responsibilities are carried out within established policies, procedures, standards, rules, and laws. However, incumbents are often required to work independently and make decisions in situations where clear guidelines may not be readily available. This role typically reports to the Supervising Child Custody Mediation Specialist.

Essential Functions and Duties

The Court reserves the right to assign or reassign duties as necessary to meet business and operational objectives. When assigned, all essential functions and duties listed below must be effectively accomplished. These functions may include, but are not limited to:
  • Reviewing Court case information and prioritizing assigned cases; meeting with parties to clarify the mediation process and explore custody and visitation options; promoting parental involvement in mediation; contacting collateral sources to gather and verify relevant information; responding to inquiries from customers, parents, minors' counsel, community agencies, and others.
  • Conducting confidential mediation sessions to facilitate the development of custody and visitation agreements; encouraging negotiations between parties during mediation; collaborating with involved parties and agencies to ensure the child's best interests are prioritized; when mediation does not yield an agreement, formulating and submitting a recommended custody and visitation plan to the Court.
  • Engaging with various stakeholders, including the Department of Social Services, Child Protective Services, parents, children, therapists, and minors' counsel.
  • Assessing risk factors during mediation, including domestic violence, substance abuse, and child abuse issues, and taking appropriate actions to ensure the safety and best interests of the child; reporting suspected child abuse and neglect in accordance with statutory requirements; including relevant information in Court recommendations when intensive or continued counseling is deemed necessary.
  • Providing expert professional assistance, guidance, and support to customers, the Court, and the public; managing numerous daily inquiries from customers, parents, and community agencies; staying informed about current developments in family law, juvenile policies, clinical studies, and trends related to child development and family dynamics.
  • Performing specialized administrative duties related to case management, such as accessing and reviewing case information, maintaining statistical data, providing testimony when subpoenaed, and completing other assigned Court-related reports and recommendations.
  • Participating in research relevant to the role; attending state and regional training sessions, including those focused on domestic violence and mediation, to fulfill continuing education requirements.
  • Engaging in case consultation meetings and staff meetings, providing regular updates on workload.
  • Communicating effectively, both orally and in writing, with sensitivity and discretion when handling emotionally charged issues and diverse populations.
  • Establishing and maintaining effective working relationships with judicial officers, staff, and the public.
  • Traveling between Court facilities as necessary to fulfill job responsibilities.
  • Performing other duties as assigned.
Employment Standards

Minimum Qualifications

As outlined in California Family Code sections 1815, 1816, and 3164, candidates for this classification must possess the following qualifications:

Education: A master's degree from an accredited institution in social work, psychology, marriage and family therapy, or other behavioral sciences related to interpersonal relationships.

Experience: A minimum of two (2) years of experience in counseling or psychotherapy, preferably in a context related to family conciliation and with the ethnic population to be served.

Desirable Qualifications

Current State of California license as a Clinical Social Worker (LCSW), Marriage and Family Therapist (MFCC or LMFT), Licensed Professional Counselor (LPC), or Clinical Psychologist.

Knowledge and Abilities

Knowledge of:
  • Interviewing techniques, conflict resolution, case management, crisis intervention, mediation, and risk assessment.
  • Community resources available for client referrals.
  • Psychological principles related to family dynamics and child development.
  • Legal terminology, Court operations, and procedures.
  • Effective communication and report writing skills.
Ability to:
  • Interpret and evaluate family behavior information from various sources.
  • Facilitate the development of parenting plans.
  • Communicate clearly and empathetically under stressful conditions.
  • Recognize dysfunctional interaction patterns and recommend interventions.
  • Maintain confidentiality and protect clients' rights.
Other Requirements
  • Possession of a valid driver's license may be required depending on the position.
  • Candidates must pass a fingerprint clearance by the Federal Bureau of Investigation (FBI) and Department of Justice (DOJ).
  • All Court employees must take the Oath of Allegiance.
Physical Demands and Work Environment

Physical Requirements: Ability to use a keyboard and monitor; communicate effectively with the public and Court staff; sit for extended periods; walk within Court facilities; lift and carry materials weighing up to 25 pounds; and speak clearly on the telephone and before groups.

Working Environment: Work is performed in an office setting with minimal exposure to outside conditions. The incumbent's working conditions are typically quiet, but may vary at different locations. Normal business hours are Monday through Friday. This position is exempt from the Fair Labor Standards Act and is not eligible for overtime.
