Position Overview:

The Arizona Attorney General's Office, specifically within the Civil Litigation Division's Consumer Protection and Advocacy Section, is on the lookout for a Senior Litigation Counsel . This role involves the critical assessment, prioritization, and response to allegations of consumer fraud and other unlawful activities.

Remote Work Options: This position may allow for remote work up to two days per week.

Key Responsibilities:

The selected candidate will oversee and execute both formal and informal investigations. Responsibilities include managing all stages of consumer fraud litigation, such as discovery, motion practice, trial proceedings, and appeals across various judicial levels, including administrative hearings, state superior courts, and federal courts, particularly in complex litigation scenarios.

Under the guidance of the Chief Counsel, the Senior Litigation Counsel will support civil litigation initiatives throughout the section, focusing on complex litigation and trial practices related to consumer fraud. This role will also involve mentoring junior attorneys, offering guidance, feedback, and collaborative support.

The position requires the development of interdepartmental cooperation to enhance the Office's capacity to address litigation emergencies and engage in significant legal actions. The Senior Litigation Counsel will be responsible for individual assignments while also serving as a resource for other attorneys, staff, and management, providing legal advice and support.

Legal Advisory Role:

The Senior Litigation Counsel will deliver both written and verbal legal opinions on a diverse range of legal and policy matters arising within the Consumer Protection and Advocacy Section. Additionally, involvement in legislative and community education initiatives is expected.

Collaboration with other attorney general offices on multi-state litigation and related activities will also be part of the role, including potential assignments to executive committees for multi-state litigation efforts.

Required Knowledge, Skills, and Abilities:

Candidates must possess a comprehensive understanding of civil procedures, filing deadlines, and the ability to produce professional legal documents promptly while staying updated on new statutes and case law.

A solid grasp of relevant consumer fraud statutes, Arizona state laws, federal regulations concerning consumer issues, and the procedural rules of state and federal courts is essential.

Additionally, familiarity with legal techniques, American jurisprudence, and the formats used in legal documentation is required.

The ideal candidate will have insights into the practical factors influencing investigative and litigation strategies, including responses from targets and defendants, opposing counsel tactics, judicial viewpoints, and considerations for victims and witnesses. Experience in settlement negotiations and an understanding of financial implications for both the state and defendants are also important.

Essential Skills:

Key skills include legal and factual analysis, legal research, proficient legal writing, oral advocacy, and negotiation capabilities. Other valuable skills encompass public speaking, media communication, trial preparation, and investigative techniques, along with the ability to collaborate effectively with law enforcement and witnesses.

Candidates must demonstrate the ability to identify issues and provide clear analyses of legal documents and records. Proficiency in preparing legal briefs, memoranda, and correspondence independently and efficiently is necessary.

Interpersonal Abilities:

Effective communication, sound judgment, high ethical standards, and empathy towards colleagues are crucial. The ability to perform well under pressure and time constraints is also essential.

Additional Requirements:

- A valid Arizona Driver's License is required, along with periodic driving record checks.
- Admission to the Arizona State Bar in good standing is mandatory.
- Submission of a writing sample that analyzes a substantive legal issue is required.
- Successful completion of a criminal background check is necessary prior to any job offer.
