The Environmental and Regulatory Legal Advisor will report to the Managing Counsel - Environmental & Regulatory and will leverage their expertise in environmental and regulatory law to offer legal guidance and support to Refining and Midstream operations. This role is crucial in assisting with the research, reporting, management, and resolution of legal matters within the Environmental & Regulatory practice group of a prominent, publicly-traded, integrated midstream and downstream energy corporation.
Key Responsibilities:
- Delivering daily legal advice and guidance to operational facilities regarding environmental and regulatory concerns, compliance strategies, and enforcement resolutions.
- Advising on compliance with the Toxic Substances Control Act.
- Conducting comprehensive legal research (federal and state equivalents) on various environmental statutes including the Clean Air Act, Clean Water Act, CERCLA/Superfund, EPCRA, NEPA, TSCA, Endangered Species Act, Oil Pollution Act, Safe Drinking Water Act, Solid Waste Disposal Act, and OSHA and PHMSA regulations.
- Overseeing, monitoring, and advocating for the company's interests in multi-party Superfund Site engagements, including participation in discussions and meetings with regulatory agencies and other responsible parties.
- Investigating the facts surrounding environmental and regulatory issues, including CERCLA/Superfund and Fuels/Renewable Fuels registration, to draft and prepare responses for governmental entities.
- Maintaining records of past and ongoing reportable matters for quarterly SEC Reporting of Legal Proceedings.
- Collaborating with HSE and External Reporting to complete and submit RCRA and UST financial assurance filings to various state and federal environmental authorities.
- Keeping updated on trends and developments in environmental and regulatory legislation, case law, and industry settlements.
- Legally authorized to work in the job posting country.
- J.D. from an accredited law institution.
- Currently licensed and in good standing to practice law in relevant jurisdictions.
- A minimum of 5 years of experience with a solid understanding of environmental and regulatory law pertinent to the energy sector.
- Proficient knowledge of one or more of the following: Clean Air Act, Clean Water Act, CERCLA/Superfund, EPCRA, NEPA, TSCA, Renewable Fuel registration, Endangered Species Act, Oil Pollution Act, Safe Drinking Water Act, RCRA, Solid Waste Disposal Act, OSHA, or PHMSA.
- Strong technology skills, particularly with Microsoft Office Suite including Word, Excel, PowerPoint, SharePoint, and document comparison tools.
- Willingness and ability to travel up to 15% of the time.
- Experience in compliance counseling, advising on environmental issues in corporate and commercial transactions, due diligence, and interactions with relevant regulatory bodies. Familiarity with air emissions, industrial and hazardous waste, water quality, wetlands, endangered species, contaminated properties, and other state and federal environmental regulations is advantageous.
- Background in oil & gas, refining, energy, or petrochemical sectors is a plus.
- Strong initiative, discipline, and commitment to excellence, customer service, and continuous improvement.
- Exceptional negotiation, presentation, collaboration, and diplomacy skills with sound judgment and discretion.
- Ability to effectively manage and prioritize a diverse range of assignments that may be complex and require teamwork with experienced legal professionals and personnel across various departments.
- Outstanding written and verbal communication skills.
- Capability to perform well under pressure, meet deadlines, and work independently with minimal supervision.
- Quick learner with the ability to apply company policies, procedures, and industry practices.
