Position Overview:
The Arizona Attorney General's Office, specifically within the Civil Litigation Division and the Consumer Protection and Advocacy Section, is in search of a Senior Litigation Counsel. This role is pivotal in assessing, prioritizing, and addressing allegations of potential consumer fraud and associated illegal activities.
Remote Work Options: This position may allow for remote work up to two days per week.
Key Responsibilities:
The selected candidate will oversee and execute both formal and informal inquiries. Responsibilities include managing all aspects of consumer fraud litigation, which encompasses discovery, motion practice, trial proceedings, and appeals in various judicial settings, including administrative hearings, state superior courts, and federal courts, as well as appellate courts when necessary, particularly in complex cases.
Under the guidance of the Chief Counsel, the individual will support civil litigation initiatives throughout the Section, focusing on intricate litigation and trial practices related to consumer fraud. The role also involves mentoring and advising junior attorneys, offering guidance, reviewing work, and collaborating on cases. The Senior Litigation Counsel will enhance interdepartmental cooperation to bolster the Office's capacity to address litigation emergencies and engage in significant legal battles.
Additionally, the position entails providing both written and verbal legal opinions and guidance on a diverse range of legal and policy matters that arise within the Consumer Protection and Advocacy Section. The candidate will also contribute to legislative efforts and community education initiatives.
The role includes participation and coordination with other attorney general offices in multi-state litigation and related activities, with potential assignments to executive committees for such litigation.
Required Knowledge, Skills & Abilities:
Candidates must be well-versed in civil procedures, adhere to filing deadlines, and complete tasks promptly while producing professional legal documents. A comprehensive understanding of applicable consumer fraud laws, Arizona statutes, federal regulations concerning consumer issues, and the procedural rules of state and federal courts is essential.
The ideal candidate will possess knowledge of legal methodologies and fundamental principles of American law, as well as the formats used in drafting legal documents.
Furthermore, candidates should be familiar with the practical elements influencing investigative and litigation strategies, including responses from targets and defendants, tactics employed by opposing counsel, judicial viewpoints, and considerations for victims and witnesses. Experience in settlement negotiations and awareness of financial implications for both the state and defendants is also necessary.
Essential Skills:
Skills required include legal and factual analysis, legal research, proficient legal writing, effective oral communication, and negotiation abilities. Additional competencies encompass advocacy, public speaking, media relations, trial skills, investigative techniques, and the capacity to collaborate closely with law enforcement and witnesses.
Candidates must be adept at identifying issues and preparing concise analyses of legal documents and records, as well as drafting legal briefs, memoranda, and correspondence efficiently with minimal oversight.
Interpersonal Abilities:
The ability to interact effectively with witnesses, colleagues, representatives from state and federal agencies, and court personnel is crucial. Candidates should demonstrate strong interpersonal communication skills, sound judgment, high ethical standards, empathy towards colleagues, and the ability to perform well under pressure and time constraints.
Technical Proficiency:
Proficiency in operating common software and equipment used in modern work environments is required.
Pre-Employment Requirements:
- Travel is a requirement for this position, necessitating a valid Arizona Driver's License and consent for periodic driving record checks.
- Admission to and good standing with the Arizona State Bar is mandatory.
- Attorney applicants must submit a writing sample demonstrating analytical skills on a substantive legal issue.
- All candidates under serious consideration will undergo fingerprinting and a criminal background check.
