Position Overview: We are in search of a Senior Real Estate Attorney to join our legal team. This role will provide essential legal support to our property development division and various departments across the organization, focusing on all facets of real estate transactions, including leasing, acquisition, management, development, and divestiture.

Key Responsibilities:

  • Conduct comprehensive legal reviews, drafting, and negotiations of all real estate contracts for TJX and its divisions, which encompass:
  • Leases and associated documents for retail locations, corporate offices, distribution centers, and warehouses.
  • Amendments to leases, including extensions, rent modifications, and adjustments related to shopping center redevelopment.
  • Preparation of waiver letters addressing use restrictions and exclusivity agreements.
  • Drafting estoppel certificates and non-disturbance agreements with lenders and property owners.
  • Management of subleases and lease assignments to third parties.
  • License agreements for parking lot usage and storage during peak operational periods.
  • Providing legal advice on landlord/tenant/subtenant notifications and disputes.
  • Assessing use restrictions impacting stores in collaboration with merchandising departments.
  • Advising various teams, including real estate, lease administration, tax, and CAM audit, on lease interpretation and contractual provisions.
  • Assisting in the resolution of contractual disputes and the enforcement of rights under real estate agreements.
  • Collaborating with external counsel and internal management on litigation strategies and settlement discussions.

Qualifications:

  • Juris Doctor (JD) degree is required.
  • Must be licensed to practice law in Massachusetts or eligible for In-House Counsel Registration.
  • 3-10 years of experience in real estate law is essential; experience in a large law firm is preferred.
  • Exceptional verbal and written communication skills.
  • Strong attention to detail with a proven track record in drafting various real estate documents.
  • Self-driven with the ability to work independently.
  • Proficient in collaborating within a team-oriented environment alongside other legal professionals and business stakeholders.
